Book excerpt: This epidemiologic study used a historical prospective study design to examine the relationship between the results of medical sexual assault evidentiary examinations and law enforcement outcomes in cases of reported sexual assault. The study sample consisted of three calendar years of cases reported to law enforcement, 1994-1996. The primary hypothesis of this study was that significant differences in the character and context of sexual assaults based on the age of the victim, and the relationship of the victim to the suspect, may affect evidentiary exam findings and their ultimate use by law enforcement. Twenty variables describing the assault were abstracted from police logs. Significant univariate differences were found both by victim age group and relationship to the suspect. Overall, 57% of the 1,228 victims in the study sample received a medical sexual assault evidentiary examination. Multivariate logistic regression found the largest predictor of the receipt of an evidentiary exam to be the victim's reporting within 72 hours of the assault (OR 12.8 yes/no), followed by the suspect(s) use of a weapon (OR 3.3 yes/no), the suspect(s) use of physical force extrinsic to the rape (OR 1.6 yes/no), and a night assault (OR 1.5 night/day). Sexual assault evidentiary exams were performed using colposcopy. Overall, 73% of the 642 exams abstracted for this study had documented injuries to the victim's genitals, anus or rectum, and 53% had documented non-genital bodily injury. Adults were more likely to sustain multiple sites of non-genital bodily injury than adolescents, however no differences were found by age group or relationship to the suspect in the percent of cases with documented genital or anal/rectal injuries (even among sub-categories of acquaintance assaults). For cases involving adult victims, multivariate logistic regression found four variables to be significantly associated with suspect charging including the suspect(s) use of a weapon, the year of report, and evidence of genital and non-genital injury documented on the medical evidentiary exam. Differences were found in the predictors of suspect charging for cases involving adolescents compared to adult victims. The reasons for these differences are explored. Further studies are needed to determine how medical evidentiary exam results are being used toward prosecutorial outcomes, and to evaluate other factors that affect criminal justice decision-making in cases of reported sexual assault.
