Download or read book Fifty Years of the Law of the Sea written by Shigeru Oda and published by Martinus Nijhoff Publishers. This book was released on 2003-01-01 with total page 862 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book is a collection of articles, primarily on the law of the sea, by Judge Shigeru Oda, who has served three successive terms of office on the Bench of the International Court of Justice, for an unprecedented 27-year tenure as Judge. A pioneer in the field of the law of the sea in the early post-war period, Judge Oda has maintained an interest in his chosen field and this collection of his works, produced over a period beginning in 1955 and spanning nearly half a century, sheds light on the rapid development of the law of the sea during this period. Those interested in understanding the law of the sea as it now stands must also understand the process by which the law has evolved since the 1950s. This book also contains a special section of Judge Oda's writings on the International Court of Justice. These chapters are aimed at elucidating the procedure of the Court.

Available in PDF, EPUB and Kindle. Book excerpt: In the late twentieth century, as the United Nations struggled to come up with a new legal system for the oceans, one woman saw the opportunity to promote radical new ideas of justice and internationalism. Ocean governance expert Elisabeth Mann Borgese (1918–2002) spent decades working with the United Nations Law of the Sea Convention. Throughout this sprawling series of global conferences, she navigated allegiances and enmities, intrigues and setbacks, fighting determinedly to develop a just ocean order. Featuring extensive research and new interviews with Mann Borgese’s colleagues and family, this book explores timeless questions of justice and international collaboration and asks whether the extraordinary drive and vision of a single person can influence the course of international law.

Book The Law of Territorial Waters of Mid Ocean Archipelagos and Archipelagic States

Download or read book The Law of Territorial Waters of Mid Ocean Archipelagos and Archipelagic States written by Barry Hart Dubner and published by Springer. This book was released on 2013-12-01 with total page 130 pages. Available in PDF, EPUB and Kindle. Book excerpt: It is a truism that the increasingly rapid movement in technology is forcing change and shift in the norms of international law. The 149 states of the Law of the Sea Conferences of the United Nations have been attempting to establish and develop adequate legal norms that will take into account the need for the orderly growth and use of the changing technological capabilities and the resulting economic development that cannot and should not be hindered by in adequate law. When such norms are identified and agreed by a substantial majority of states, they are usually set out and placed into multilateral treaties. The rules governing the resource and non-resource allocation of the oceans and the uses ofthe oceans have posed major difficulties for the development of international law for many years. The Geneva Conference of 1958 building upon the groundwork of the International Law Commission of the United Nations shaped a rough structure for a 20th Century Law of the Seas and for mulated the effort in four major international conventions. But a majority of the states failed to ratify or accede to the conventions. Even had they become effec tive as the expression of the Law of the Seas in the second half of the 20th Cen tury, there was one glaring area of omission: a conventional law for the waters of mid-ocean archipelagos and archipelagic states.

Book Tracing the Blue Economy

Download or read book Tracing the Blue Economy written by Awni Behnam and published by Lulu.com. This book was released on 2013-11-02 with total page 102 pages. Available in PDF, EPUB and Kindle. Book excerpt: Forming part of the Fondation de Malte's LUMEN Monograph Series, in this text Dr. Awni Behnam, President of the International Ocean Institute and former Assistant Secretary-General of the United Nations, explores how we must live "with the ocean and from the ocean in a sustainable relationship".The interconnectedness of emerging global challenges is forcing a policy dimension change in the form of the Blue Economy as an integrated approach to the governance of the ocean and urban interface, revolving around the human dimension. The paradigm shift came when Elisabeth Mann Borgese - founder of the International Ocean Institute - viewed the situation from the seaward side, where a sustainable ocean economy integrates with and is inclusive of the Green Economy. She famously stated "if before you saw the sea and the sea floor as a continuation of the land, you now see the land as a continuation of the sea,"; the concept of the Blue Economy is an attempt to do justice to that genius vision.

Available in PDF, EPUB and Kindle. Book excerpt: This work presents an in-depth analysis of the most complex of the many ocean boundary delimitation problems confronting neighboring states in the Pacific region. In each case the various factors influencing the parties to the dispute are examined in detail & alternative diplomatic options are compared. Special emphasis is given to the problems of Southeast Asia, East Asia, & the Northeast Pacific, but regional developments in the Southwest Pacific & the Central & Southeast Pacific are also discussed. Book Liber Amicorum Judge Shigeru Oda 2 vols

Download or read book Liber Amicorum Judge Shigeru Oda 2 vols written by Nisuke Ando and published by BRILL. This book was released on 2021-12-06 with total page 855 pages. Available in PDF, EPUB and Kindle. Book excerpt: Judge Shigeru Oda, having served since 1976 in three successive nine-year terms on the International Court of Justice, has helped to shape the Court's jurisprudence for over a quarter century. His influence on the law of the sea spans an even longer period, beginning with his doctoral dissertation at Yale Law school in the 1950s and continuing with his involvement in the First, Second and Third UN Conferences on the Law of the Sea. In a tribute to Judge Oda's significant contributions to international law, leading scholars on the law of the sea, international dispute settlement and the ICJ itself have produced a Festschrift in his honour that promises to be a standard reference work on these topics for years to come. This two volume work, containing over 95 articles, begins by examining the role of the international judge and the jurisdiction of international tribunals (including reservations to jurisdiction, the Optional Clause, the Special Agreement, and the power to indicate special measures). It contains a particularly lively debate regarding the proliferation of international tribunals and whether the potential for conflicting decisions is problematic or productive. Other areas of focus include the history and current development of the law of the sea; the first in-depth examination of the establishment and first decisions of the International Tribunal for the Law of the Sea; and the ICJ's treatment of the development, doctrines and sources of international law. Further sections are devoted to International Litigation as analysed by leading practitioners; Land and Maritime Boundaries, International Watercourses and Other Waters; and Defence, the Use of Force and the Law of Armed Conflict. The composition of the editorial team - Nisuke Ando of Kyoto, Edward McWhinney of Ottawa and Rüdiger Wolfrum of Heidelberg - reflects Judge Oda's truly international career and the extent to which his work has drawn from and contributed to diverse legal traditions.
