For the most part it is nomadic groups who have been the losers in these conflicts. The idea of human rights has traveled around the world in response to some of the great conflicts of our time. ‘The Right to Roam- Travellers in the Modern Nation State’ examines the right of nomadic groups to maintain a way of life that is contrary to the drive toward sedentarisation and modernisation. If human rights are to exist, one approach to the derivation of rights is that they are to exist as protectors of the autonomy of individuals. When the autonomy of individuals is threatened by restrictions on their liberty then the protection of human rights is required. For Travellers in Ireland, restrictions on the freedom to maintain a Travelling lifestyle have consequences for members of the Travelling community. “The Right to Roam- Travellers in the Nation State’ explores the impact of recent legislation such as the Housing (Miscellaneous Provisions) Act of 2002 on Travellers in modern Ireland and whether progress driven be sedentary society should be required to include the needs of nomadic groups.

The approaches adopted in this volume range from critical theory, semiotics, discourse and cultural analysis to intersectional perspectives. Many contributors here argue for a conceptual understanding of this phenomenon that goes beyond the notions of anti-Romani racism or Romaphobia, suggesting a shift in focus towards the prevailing prejudice in majority societies. The controversial core theme discussed in this book is the appropriateness and the theoretical understanding of the term 'antiziganism' and its analogue 'antigypsyism.' The essays explore empirical findings from the news media, film, literature and theatre, as well as contemporary and historical realities in Germany, Kosovo, Norway, the former Ottoman Empire, the Soviet Union, Romania, Sweden, and the US. The striking historical and geographic continuity of stereotypes and the different modes of antiziganist practice comprise a central theme here, along with a focus on the counter-discourse of Romanies. Since comprehensive literature on this topic in Romani studies has, to date, been rare, this volume provides necessary readings for the debate among scholars, policy-makers and activists.

The book’s central aim is to research how a societal problem can be improved upon from a legal perspective. The controversy surrounding ethnic data collection and positive action severely limits their use at the national level. Accordingly, legal and political concerns are analysed and addressed in order to demonstrate that it is possible to collect such data and to implement such measures while fully respecting international and European human rights norms, provided that certain conditions are met. Part I focuses on ethnic data collection and explores the key rules and principles that govern it, the ways in which this equality tool could be used, and how potential obstacles might be overcome. It also identifies and addresses the specific challenges that arise when collecting ethnic data on the Roma minority in Europe. In turn, Part II explores positive action and the broad range of measures covered by the concept, before analysing the applicable international and European framework. It reviews the benefits and challenges of implementing positive action for Roma, identifies best practices, and gives special consideration to inter-cultural mediation in the advancement of Roma inclusion. The book concludes with an overview of the main findings on both topics and by identifying three essential elements that must be in place, in addition to full respect for the applicable legal rules, in order to combat discrimination and achieve the inclusion of Roma in Europe by complementing existing anti-discrimination frameworks with the collection of ethnic data and the implementation of positive action schemes.
