Book Freedom of Speech A Comparative Law Perspective

Download or read book Freedom of Speech A Comparative Law Perspective written by Grzegorz Blicharz and published by Wydawnictwo Instytutu Wymiaru Sprawiedliwości. This book was released on 2019 with total page 584 pages. Available in PDF, EPUB and Kindle. Book excerpt: Freedom of Speech: A Comparative Law Perspective offers a wide-ranging review of free speech law in Europe, the U.S., Canada and Australia, with a special focus on hate speech and on artistic and scientific speech. It provides a great deal of information on these topics, in a single volume, which presents a considerable value to anyone who wants to study the subject. prof. Christopher Wolfe, University of Dallas The book is disturbing. It encourages to pose serious questions, in particular about the phenomenon of the persecution for expressing traditional views, which ceased to be accepted by certain political and intellectual elites. It presents the context which allows us to realize how difficult it is to address such issues. Nevertheless, searching for the answers seems absolutely necessary. The analyses of the US law could be considered a universal parable about the awareness of free speech. The analyses of the law in other countries warn us how fragile the protection of freedom of expression is. prof. Franciszek Longchamps de Bérier, Jagiellonian University in Kraków The volume focuses on an important and complex theoretical question of practical value which is inscribed in the debate on the limits of freedom of speech. It is a collection of independent studies with a clearly presented central idea. Written by the authors representing not only different academic institutions and countries but even different legal cultures. Such a choice of authors offers a variety of presented evaluations, which testifies to the richness of content included in the book and is an invitation to further studies and analyses. prof. Wojciech Lis, John Paul II Catholic University of Lublin

Book Defending Pornography

Download or read book Defending Pornography written by Nadine Strossen and published by NYU Press. This book was released on 2024-03-05 with total page 218 pages. Available in PDF, EPUB and Kindle. Book excerpt: Named a Notable Book by The New York Times Book Review in 1995, Defending Pornography examines a key question that has divided feminists for decades: is censoring pornography good or bad for women? Nadine Strossen makes a powerful case that increasing government power to censor sexual expression, beyond the limits that the First Amendment sensibly permits (for example, outlawing child pornography) would do more harm than good for women and others who have traditionally been marginalized due to sex or gender, She explains how the very anti-porn laws pushed by some feminists have led to the censorship of LGBTQ+ and feminist works, and she examines the startling connections between anti-porn feminists and right-wing fundamentalists. In an illuminating new Preface, Strossen lays out the multiple current assaults on sexual expression, which continue to come from across the ideological spectrum. She shows that freedom for such expression remains an essential prerequisite for the equality, safety, and dignity of women and sexual/gender minorities.

Book Aspects of Regulating Freedom of Expression on the Internet

Download or read book Aspects of Regulating Freedom of Expression on the Internet written by Dragoş Cucereanu and published by . This book was released on 2008 with total page 304 pages. Available in PDF, EPUB and Kindle. Book excerpt: This research aims at determining criteria for regulation of freedom of expression exercised on the internet, allowing a "fair balance" between that freedom and other competing interests. It will hopefully benefit lawyers and courts which have to deal with an increasing number of cases involving online speech. It can also assist legislators when they consider adopting or amending legislation regulating online speech, potentially preventing the adoption of legislation contrary to Article 10 of the European Convention on Human Rights. Internet service and content providers may also find interesting to see the part dealing with the distribution of liabilities amongst the participants to online communication. To that effect, the research develops methods of analysing the specific effect which the various features of the internet may have on freedom of expression and on its regulation, and provides examples of criteria identified through those methods, in selected areas such as hate speech, defamation or adult speech. The book identifies general principles of freedom of expression which are less likely to change with time and technology, and considers how they can be transposed to the online reality. For instance, the general principle that minors are to be protected from adult material has found various specific incarnations in rules such as demanding an identification document in a shop or a cinema or the late-hour broadcast rule in TV and radio, based on the presumption that unaccompanied minors are unlikely to be exposed. Neither of these is readily available on the internet (there is no "late hour" in this always-on medium), and so the principle had to find another expression aimed at age identification, such as the use of credit card numbers. The book analyses the reasons for the lack of a global, comprehensive approach to cyberspeech regulation and concludes that the main obstacle is not grounded in any features of the internet, but rather in the absence of universal agreement on the substantive rules to regulate online speech. Pending such agreement, domestic authorities and regional organizations will still deal with the issue, and the methods proposed here may be of assistance.

  • Pages : 586 pages

Download or read book Law and Democracy written by Tom Campbell and published by Routledge. This book was released on 2003 with total page 586 pages. Available in PDF, EPUB and Kindle. Book excerpt: The study of law is a branch of the study of politics. Even those who emphasize the autonomy of law, either sociologically or normatively, must acknowledge that this is a position that requires justification within a broader theory of politics that either explains or justifies this autonomy. Inevitably, therefore, developments in political life and in political philosophy have a significant effect on the practice of law and its theoretical study. Currently this relationship is evident in the impact of recent developments in the practice and theory of democracy that are redolent with implications for law and legal theory. This collection represents the body of captivating literature that is engaged not only with current developments in law and politics but also with the rediscovery of traditional theories. It offers a way into an engaging and important debate that bears of the most fundamental issues within both legal and political theory.
