Download or read book Jurists and Legal Science in the History of Roman Law written by Aldo Schiavone and published by Routledge. This book was released on 2021-10-11 with total page 318 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book provides a new approach to the study of the History of Roman Law. It collects the first results of the European Research Council Project, Scriptores iuris Romani - dedicated to a new collection of the texts of Roman jurisprudence, highlighting important methodological issues, together with innovative reconstructions of the profiles of some ancient jurists and works. Jurists were great protagonists of the history of Rome, both as producers and interpreters of law, since the Republican Age and as collaborators of the principes during the Empire. Nevertheless, their role has been underestimated by modern historians and legal experts for reasons connected to the developments of Modern Law in England and in Continental Europe. This book aims to address this imbalance. It presents an advanced paradigm in considering the most important aspects of Roman law: the Justinian Digesta, and other juridical late antique anthologies. The work offers an historiographic model which overturns current perspectives and makes way for a different path for legal and historical studies. Unlike existing literature, the focus is not on the Justinian Codification, but on the individualities of ancient Roman Jurists. As such, it presents the actual legal thought of its experts and authors: the ancient iuris prudentes. The book will be of interest to researchers and academics in Classics, Ancient History, History of Law, and contemporary legal studies.
Download or read book Libertad de emprender written by Daniel M. Mondéjar and published by Editorial Almuzara. This book was released on 2012-03 with total page 373 pages. Available in PDF, EPUB and Kindle.

Download or read book The Problem of Evil in the Ancient World written by Mark Edwards and published by Wipf and Stock Publishers. This book was released on 2023-06-22 with total page 365 pages. Available in PDF, EPUB and Kindle. Book excerpt: The aim of this book is to ascertain how ancient Greek and Latin authors, both pagan and Christian, formulated and answered what is now called the problem of evil. The survey ranges chronologically from the classical and Hellenistic eras, through the Roman era, to the end of the pagan world. Six of the twelve chapters are devoted to Christianity (including Manichaeism), as one thesis of the book is that the problem of evil takes an acute form only for Christians, since no other philosophy of antiquity posits a personal God exercising providence over individuals without having to overcome countervailing forces. None the less it will also be shown that Greek philosophies, Platonism in particular, come close to the Christian formulation. Being conscious of the affinity between Greek thought and their own, early Christians respond to the problem of evil in the same way as the philosophers, by questioning the existence of evil rather than of the divine.
Download or read book Censure and Heresy at the University of Paris 1200 1400 written by J. M. M. H. Thijssen and published by University of Pennsylvania Press. This book was released on 2011-09-16 with total page 205 pages. Available in PDF, EPUB and Kindle. Book excerpt: For the scholastic philosopher William Ockham (c. 1285-1347), there are three kinds of heresy. The first, and most unmistakable, is an outright denial of the truths of faith. Another is so obvious that a very simple person, even if illiterate, can see how it contradicts Divine Scripture. The third kind of heresy is less clear cut. It is perceptible only after long deliberation and only to individuals who are learned, and well versed in Scripture. It is this third variety of heresy that J.M.M.H. Thijssen addresses in Censure and Heresy at the University of Paris, 1200-1400. The book documents 30 cases in which university trained scholars were condemned for disseminating allegedly erroneous opinions in their teaching or writing, and focuses particularly on four academic censures that have occupied prominent positions in the historiography of medieval philosophy. Thijssen grants central importance to a number of questions so far neglected by historians regarding judicial procedures, the authorities supervising the orthodoxy of teaching, and the effects of condemnations on the careers of the accused. He also places still current questions regarding academic freedom and the nature of doctrinal authority into their medieval contexts.
