Book The Paradox of Openness

Download or read book The Paradox of Openness written by and published by BRILL. This book was released on 2014-11-13 with total page 285 pages. Available in PDF, EPUB and Kindle. Book excerpt: The ‘open society’ has become a watchword of liberal democracy and the market system in the modern globalized world. Openness stands for individual opportunity and collective reason, as well as bottom-up empowerment and top-down transparency. It has become a cherished value, despite its vagueness and the connotation of vulnerability that surrounds it. Scandinavia has long considered itself a model of openness, citing traditions of freedom of information and inclusive policy making. This collection of essays traces the conceptual origins, development, and diverse challenges of openness in the Nordic countries and Austria. It examines some of the many paradoxes that openness encounters and the tensions it arouses when it addresses such divergent ends as democratic deliberation and market transactions, freedom of speech and sensitive information, compliant decision making and political and administrative transparency, and consensual procedures and the toleration of dissent. Contributors are: Ainur Elmgren, Tero Erkkilä, Norbert Götz, Ann-Cathrine Jungar, Johannes Kananen, Lotta Lounasmeri, Carl Marklund, Peter Parycek, Johanna Rainio-Niemi, Judith Schossböck, Ylva Waldemarson, and Tuomas Ylä-Anttila.

Book The Laws of Transparency in Action

Download or read book The Laws of Transparency in Action written by Dacian C. Dragos and published by Springer. This book was released on 2018-07-20 with total page 676 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book examines the issue of free access to information as part of the openness and transparency principles. The free access to public information has become one of the most hotly contested aspects of contemporary government and public administration. Many countries in Europe have well-established Freedom of Information laws (FOIAs), while others have adopted them more recently. The problems that occur in the implementation of FOIAs are different due to the legal and institutional context; nevertheless, patterns of best practices and malfunctioning are comparable. The book analyses in comparative and empirical perspective the respective main challenges. Whilst the existing literature focusses on the legal provisions, this book offers practical insights through 13 national profiles and the EU level, on how effective the legal provisions of FOIAs really prove to be.

Book Openness Transparency and Access to Documents and Information in the European Union

Download or read book Openness Transparency and Access to Documents and Information in the European Union written by and published by . This book was released on 2013 with total page 40 pages. Available in PDF, EPUB and Kindle. Book excerpt: The Treaty of Lisbon updates the terms under which the principles of transparency and openness clarify the right of public access to documents in the European Union. This right is both a fundamental right of individuals and an institutional principle. The revision of Regulation (EC) No 1049/2001, which sets out the arrangements for this, is influenced, to a large extent, by the numerous interpretations from the Court of Justice of the European Union, particularly during the last five years. Observation of the practice followed by the EU institutions and the broad lines of the practices followed nationally indicate that EU law needs to undergo extensive revision, with the aim of both leveraging the case law experience acquired and bringing itself up to date.

Book Access to Information in the European Union

Download or read book Access to Information in the European Union written by Herke Kranenborg and published by ISBS. This book was released on 2005 with total page 146 pages. Available in PDF, EPUB and Kindle. Book excerpt: In the last 15 years, transparency has been one of the central themes in the European integration process. By providing more openness about its activities, the European Union tries to bring itself closer to its citizens. Transparency is considered one of the main methods to relieve the 'democratic deficit'. One way of increasing transparency is to grant citizens a right to access information. Another way is to actively publish information. Transparency is not an exclusive feature of European integration. On the contrary, inspiration for policies on access to information is mostly drawn from the sometimes longstanding experiences of the member states. Access to Information in the European Union provides for a detailed and useful overview of EC and member state legislation in the field of access to information, highlighting the similarities and differences between national legislation of different member states.
