Book excerpt: Excerpt from On the Origin of the Laws of Nature This treatise is an extension of the 'Note on the Laws of Nature' at the end of the 6th edition of 'Astronomy without Mathematics, ' which at first related to Gravity alone. It also contains the substance of two lectures at the London Institution in 1878 and 9, which many persons wished to see printed. Some of the arguments are necessarily old, but were requisite to make the general argument complete as far as it goes. Possibly none of them may be new; for I never assume that anything is new merely because I have not seen it before or do not remember it. Nevertheless I believe that some of this reasoning will be new to most readers, if not to all, and that it is worth attending to. I have given it as concisely as possible, and with no more illustrations in any case than seemed necessary, out of the infinite number which nature affords, and of which a sufficient number may be read not only in Paley's 'Natural Theology' and the Bridgwater Treatises, but in many modern books which deny the only cause that will rationally account for their origin, as I have shown here. So, too, are the revised versions of natural law espoused by thinkers such as John Finnis and Robert George. This book focuses on three bodies of theory that developed between the thirteenth and seventeenth centuries: (1) the foundational belief in the existence of a moral/juridical natural law, embodying universal norms of right and wrong and accessible to natural human reason; (2) the understanding of (scientific) uniformities of nature as divinely imposed laws, which rose to prominence in the seventeenth century; and (3), finally, the notion that individuals are bearers of inalienable natural or human rights. While seen today as distinct bodies of theory often locked in mutual conflict, they grew up inextricably intertwines. The book argues that they cannot be properly understood if taken each in isolation from the others.

Instead of pondering on terms and phrases, we set about the investigation of phenomena. We collected and collated facts, arranging them according to their Similarities, and regardless of conventional classifications. It was while engaged in this task, groping our way step by step from the simpler phenomena to their more complex manifestations, generalizing as we went along, and grouping all related phenomena under such generalizations, carefully verifying each step before taking the next, that we have reached a' generalization which at the time seemed to embrace all the phenomena of biology. It contained the promise of the light we were in search of; to wit, the principle which would make possible a uniform and harmonious explanation of all organic phenomena. However, before accepting it as a fact and allowing ourselves to make deductions from it, we thought it necessary to verify our induction (or 'law by every possible means. On the provisional assumption, there fore, that the said induction was true, we made sundry deductions, which were in many cases (to us at least) of a surprising character. But in every such case, where the conclusions were contrary to what we believed to be the fact, we were able, either by research or by experiment, to verify the conclusion. Gathered here for the first time are the most important of his essays which together provide both a valuable introduction to Hobbes's thought and a fresh understanding of Hobbes's place in the theory of modern politics. Tracing Hobbes's work through De Cive and Leviathan, Bobbio identifies the philosopher's relation to the tradition of natural law. That Hobbes must now be understood in both this tradition as well as in the seemingly contradictory positivist tradition becomes clear for the first time in Bobbio's account. Bobbio also demonstrates that Hobbes cannot be easily labelled "liberal" or "totalitarian"; in Bobbio's provocative analysis of Hobbes's justification of the state, Hobbes emerges as a true conservative. Though his primary concern is to reconstruct the inner logic of Hobbes's thought, Bobbio is also attentive to the philosopher's biography and weaves into his analysis details of Hobbes's life and world—his exile in France, his relation with the Mersenne circle, his disputes with Anglican bishops, and accusations of heresy leveled against him. The result is a revealing, thoroughly new portrait of the first theorist of the modern state.
