Book excerpt: Excerpt from New York in the Revolution, Vol. 2: As Colony and State In 1895, Comptroller James A. Roberts, in moving some documents to make room for an extension to his office, brought to light many valuable papers relating to the Revolutionary War and the important position occupied by the State of New York in that momentous struggle. Through the kind assistance of various Legislatures, those documents were arranged and com piled and a volume issued therefrom which has been a valuable addition to the historical records of this State. One fact alone demonstrates the worth of the work which has been prosecuted in the Comptroller's Department in connection with these Revolutionary Records: The State of New York had formerly been credited with having furnished in the War for Independence but men, which number had been accepted as historically accurate. The documents which were first discovered by Mr. Roberts and afterward arranged by him and his successors, prove beyond dispute that New York's quota was at least men, giving to our State a much more commanding position as a factor in the Revolutionary contest than it had thereto fore occupied. The work which was issued by Mr. Roberts passed through two editions prior to the final arrangement of all the Revolutionary papers. On assuming the office of Comptroller, I found that the work of preparing these documents for consultation and the index to the same, had been practically completed and that the binding of the few remaining additional volumes of original documents would complete the Revolution ary work in its entirety. All that remained of interest to the general public was the printing and issuing of a Supplement or companion book to New York in the Revolution, which would give a complete resum of the Revolutionary Records of the Department. The Legislature of 1901 provided an item in the Supply Bill for this work which I now have the pleasure of adding to the historical annals of this State. The second edition of New York in the Revo lution was the roll-call of the officers and men who served in the War. This Supplement gives in a condensed form the history of the War as shown by the documents. It is not a reprint in the entirety of those documents, which only could be done at a great, and probably unwar ranted, expenditure; but it is a work calculated to give sufficient information upon the subject matter contained in those documents to answer every practical purpose. It may be that some future generation may see fit to publish all of the historical documents in this office and in other of the State departments, relating to the struggle of this Colony, with the others, for its independence. To correct this opinion, the Editor has endeavored to resuscitate from the tomb of general oblivion the names of the men who proved their attachment to the cause of liberty by serving in a military capacity as officers and soldiers of the Regiments of the New York Line on Continental Establishment, of the Battalions of Levies, organized by the State of New York for purposes of self-protection, of the Regiments of Militia, Minute Men and Rangers and - of the Navy. Although the volume herewith laid before the public contains about names, the Editor fears that many a family will be-disappointed upon not finding an ancestor, whom family tradition has elevated upon the pinnacle of revolutionary fame. The reason for not bringing such names is that the records of the war of Independence, both in the archives of New York and at Washington, are defective; for it has been the Editor's endeavor during five years, to examine every possible clue and enumerate the names there found. Smith (history (y' New York, ed. 1829, I., p. 42) attributes it to the era ot'gov. Lovelace, who succeeded Gov. Nicolls; Wood (history of Long Island, ed. 1828, p. 90, note) says. This is a gr 'at mistake. It was established by Nicolls in the code be had compiled for the government of the Colony, and published at Hempstead, March 1, 1665. Others, follow ing these authorities, have adopted one or other of these theories; but I believe the provisions of the Duke's Laws relate onlv to the regulation of the sessions of a Court of Assizes, which had been previously organ izod by order of Gov. Nicolls. The terms of the Code - inasmuch as the organization of a new Court is not alluded to, as the members of the Court are not designated, as the character and extent of its authority are not de fined or mentioned, and as the munbcr of its sessions and time and place of its meetings are the only subjects of its provisions (article Assizes, Duke's Lmrs)-it' I interpret their meaning correctly, do not establish a Court of Assizes, but merely regulate one which was already in existence, and whose sessions. By that act, were reduced in number (shall he held mr mwe in, the yea? I respectfully submit that the Dutch original, which Chalmers says Nicolls prudently copied can be tound in the Court of Director (lcncral and Council, whose Minutes are in the orlice of the Secretarv of State.
