Joseph O'Mahoney systematically analyses 21 case studies - including the Manchurian Crisis, the Turkish invasion of Cyprus and Russia's annexation of Crimea - to explore why so many states have adopted a policy of non-recognition of the spoils of war. By drawing on historical sources including recently declassified archival documents, he evaluates states' decision-making. He develops a new theory for non-recognition as a symbolic sanction aimed at reproducing common knowledge of the rules of international behaviour.

What occurred in the ensuing weeks and months has been the source of a tempestuous debate ever since. It is well known that the Japanese military committed wholesale atrocities after the fall of the city, massacring large numbers of Chinese during the both the Battle of Nanjing and in its aftermath. Yet the exact details of the war crimes--how many people were killed during the battle? How many after? How many women were raped? Were prisoners executed? How unspeakable were the acts committed?--are the source of controversy among Japanese, Chinese, and American historians to this day. In The Making of the "Rape of Nanking" Takashi Yoshida examines how views of the Nanjing Massacre have evolved in history writing and public memory in Japan, China, and the United States. For these nations, the question of how to treat the legacy of Nanjing--whether to deplore it, sanitize it, rationalize it, or even ignore it--has aroused passions revolving around ethics, nationality, and historical identity. Drawing on a rich analysis of Chinese, Japanese, and American history textbooks and newspapers, Yoshida traces the evolving--and often conflicting--understandings of the Nanjing Massacre, revealing how changing social and political environments have influenced the debate. Yoshida suggests that, from the 1970s on, the dispute over Nanjing has become more lively, more globalized, and immeasurably more intense, due in part to Japanese revisionist history and a renewed emphasis on patriotic education in China. While today it is easy to assume that the Nanjing Massacre has always been viewed as an emblem of Japan's wartime aggression in China, the image of the "Rape of Nanking" is a much more recent icon in public consciousness. The term ‘misconduct’ is not a legal notion, but is used to describe a certain phenomenon, namely, a group/class of actions. This term is convenient since it makes it possible to introduce and describe the phenomenon as such, without a division into concrete types of conduct, like ‘abuse of process’, ‘violation of national law’, ‘corruption’, ‘investment contrary to international norms and standards’, etc. The term ‘misconduct’ is intended to embrace various kinds of conduct on the part of foreign investors that the system of international investment law does not accept – such as that which it regards as illegal, against public policy, or otherwise inappropriate – and triggers legal consequences. Rarely, however, does international investment law clearly articulate what it considers unacceptable investor conduct, and certainly not in any systematic fashion. As such, this book addresses the following questions: What types of investors’ conduct are legally unacceptable? What mechanisms are available to deal with unacceptable investors’ conduct, and what are the legal consequences?

It argues that with strong leadership from Britain and France, the League made it possible for states to preserve the peace of Europe after terrorists aided by Italy and Hungary killed the King of Yugoslavia in 1934. This achievement represents the League at its most effective and demonstrates that the organization could carry out its peacekeeping functions. The League also made it possible to draft two international conventions to suppress and punish acts of terrorism. While both conventions were examples of productive collaboration, in the end, few governments supported the League’s anti-terrorism project in itself. Still, for Britain, Geneva served the cause of peace by helping states to settle their differences by mediation and concession while promoting international cooperation, a central conviction of British “appeasement” policy in the 1930s.
