La autora examina la noción de nulidad como estado del acto o como un derecho de crítica; explica sus debilidades conceptuales para señalar que en realidad constituye una sanción jurídica sustancial y objetiva, consistente en la supresión de los efectos jurídicos del acto en la medida necesaria para el restablecimiento de la legalidad transgredida durante la celebración de un contrato, con exclusión de consideraciones subjetivas, tales como la culpa de alguna de las partes o el carácter determinante de la voluntad de las partes en relación con una cláusula, para, en este caso, llegar a la nulidad parcial. Estudia asimismo, entre otras, la nulidad por vicio del consentimiento debido a un error; la concepción moderna de la nulidad analizada como una sanción; la especificidad de la responsabilidad de las partes con ocasión de la anulación del contrato; las múltiples formas de daño que puede sufrir la parte del contrato víctima de una culpa; las clases de perjuicios que puedan dar lugar a una indemnización; el fin de la nulidad; el fin de la responsabilidad; el fundamento de la obligación de restituir y el papel de las restituciones.

For long it was based on a mere five articles of the Civil Code of 1804, but on this foundation the courts and legal scholars have constructed liabilities for fault and strict liability of an extraordinary breadth and significance. While the rest of the general law of obligations (including contract) in the Civil Code was reformed in 2016 by executive ordonnance, this area was left aside, being the subject in 2017 of a proposal by the French Government for the legislative reform of the law of civil liability, a new legislative category to include both contractual and extra-contractual liability. Even in its earliest forms, it operated both as a tool to repress collective organizations and enforce labour discipline, while policing the worst excesses of industrial capitalism. Recently, governments have begun to rediscover criminal law as a regulatory tool in a diverse set of areas related to labour law: 'modern slavery', penalizing irregular migrants, licensing regimes for labour market intermediaries, wage theft, supporting the enforcement of general labour standards, new forms of hybrid preventive orders, harassment at work, and industrial protest. This volume explores the political and regulatory dimensions of the new 'criminality at work' from a wide range of disciplinary perspectives, including labour law, immigration law, and health and safety regulations.
