Updated as of May 29, 2018 In this rulemaking, EPA is making certain technical corrections to the rules establishing emission standards for nonroad diesel engines. In addition, we are amending those rules to provide nonroad diesel equipment manufacturers with a production technical relief provision for Tier 3 equipment which is similar to the technical relief provision already available for Tier 4 equipment. Like the Tier 4 provisions, the new Tier 3 technical relief provision deals with a situation where an equipment manufacturer which is not vertically integrated with its engine supplier is unable to complete redesign of the equipment within the time required by rule (here, the Tier 3 rule). To be eligible, the equipment manufacturer must show both that its inability to furnish a compliant equipment design is due to the engine supplier, and that the equipment manufacturer has exhausted other flexibilities already provided by the Tier 3 rule. The amount of relief under the Tier 3 technical relief provision is somewhat less than is available under the parallel Tier 4 provision, however. The Tier 3 Technical flexibility will apply up to a maximum of an additional 50% of production beyond the original 80% provided by the Tier 3 production flexibility provision. In addition, each grant of Tier 3 technical relief is associated with the likelihood of earlier use of Tier 4 nonroad diesel engines. The rule thus provides that for each one percent of use of Tier 3 technical relief, some percentage of the automatic Tier 4 production flexibility for the same engine power category, and some percentage of potential Tier 4 technical relief, is no longer available. The percentage varies based on the type of engine for which Tier 3 technical relief is granted, the largest Tier 4 "penalty" being associated with use of the higher emitting earlier tier engines. Some of the individual EPA-only provisions of this action may have minor impacts on the costs and emission reductions of the underlying regulatory programs amended in this action, though in most cases these are simple technical amendments. For those provisions that may have a minor impact on the costs or benefits of the amended regulatory program, any potential impacts would be small and we have not attempted to quantify the potential changes. Book excerpt: Diesel engines play a vital role in key industry sectors such as goods movement, public transportation, construction, and agriculture. A unique combination of efficiency, power, reliability, and durability make diesel the technology of choice for these sectors. However, the durability of the technology does not lend itself to rapid fleet turnover and investment in new equipment that meets more stringent environmental standards. Because of this, the full air quality benefits of the very stringent new engine emission standards in the US2007 Diesel Rule ("Heavy-Duty Engine and Vehicle Standards and Highway Diesel Fuel Sulfur Control Requirements.") and the Nonroad Diesel Rule ("Clean Air Nonroad Diesel Rule.") will likely take decades to achieve. Further, the regulatory authority of EPA and states to address the existing fleet of over 11 million diesel engines is rather limited. In response, EPA began the Voluntary Diesel Retrofit Program in 2000 to discuss broad initiatives to modernize and upgrade (i.e., retrofit) current engines with modern emission control equipment or to accelerate the replacement of these engines with newer ones. Given the diversity of applications and engines, as well as significant technical and funding issues, the Clean Diesel Retrofit Work Group was formed in 2004 under the auspices of the EPA Clean Air Act Advisory Committee (CAAAC) to advise EPA on how best to expand the initiative.This report is the culmination of the work of the Clean Diesel and Retrofit Work Group since April 2004. It provides consensus-based recommendations as well as other recommendations. Some recommendations are sector-specific; others apply more broadly. It is our hope that this report will substantially further our Nation's efforts to achieve healthy air for its citizens.

Book excerpt: The Environmental Protection Agency's (EPA) National Clean Diesel Campaign (NCDC) is a comprehensive initiative to reduce pollution from diesel engines throughout the country, including vehicles on highways, city streets, construction sites, and ports. The NCDC comprises both regulatory programs to address new engines and voluntary programs to address the millions of diesel engines already in use. On the regulatory side, EPA is successfully implementing emissions standards for engines in the 2007 Heavy-Duty Highway Engine Rule and the Tier 4 Nonroad Rule and developing new emission requirements for locomotives and marine diesel engines, including large commercial marine engines. On the voluntary side, EPA is addressing engines that are already in use by promoting a variety of innovative emission reduction strategies such as retrofitting, repairing, replacing and repowering engines; reducing idling; and switching to cleaner fuels. The voluntary programs are accomplished in partnership with state and local governments, environmental groups and industry. The emissions standards for new engines will reduce both highway and nonroad engine emissions by roughly 90%. However, these emission reductions occur over a long period of time as new engines are phased into the fleet. Retrofitting diesel engines currently in use will allow significant and immediate emission reductions from diesel engines that would not otherwise be addressed. The purpose of this technical analysis is to evaluate the cost effectiveness of retrofitting existing heavy-duty diesel engines to reduce particulate matter (PM). (The cost effectiveness of the regulatory measures EPA has implemented is addressed the rulemakings.) Analysts in EPA's Office of Transportation and Air Quality (OTAQ) evaluated the costs and emissions benefits of retrofitting school buses, freight trucks, and bulldozers with diesel oxidation catalysts (DOCs) and catalyzed diesel particulate filters (CDPFs), two of the most common PM emissions reduction technologies for diesel engines.

Updated as of May 29, 2018 Under the Clean Air Act Section 211(o), as amended by the Energy Independence and Security Act of 2007 (EISA), the Environmental Protection Agency is required to promulgate regulations implementing changes to the Renewable Fuel Standard program. The revised statutory requirements specify the volumes of cellulosic biofuel, biomass-based diesel, advanced biofuel, and total renewable fuel that must be used in transportation fuel. This action finalizes the regulations that implement the requirements of EISA, including the cellulosic, biomass-based diesel, advanced biofuel, and renewable fuel standards that will apply to all gasoline and diesel produced or imported in 2010. The final regulations make a number of changes to the current Renewable Fuel Standard program while retaining many elements of the compliance and trading system already in place. This final rule also implements the revised statutory definitions and criteria, most notably the new greenhouse gas emission thresholds for renewable fuels and new limits on renewable biomass feedstocks. This rulemaking marks the first time that greenhouse gas emission performance is being applied in a regulatory context for a nationwide program. As mandated by the statute, our greenhouse gas emission assessments consider the full lifecycle emission impacts of fuel production from both direct and indirect emissions, including significant emissions from land use changes. In carrying out our lifecycle analysis we have taken steps to ensure that the lifecycle estimates are based on the latest and most up-to-date science. The lifecycle greenhouse gas assessments reflected in this rulemaking represent significant improvements in analysis based on information and data received since the proposal. However, we also recognize that lifecycle GHG assessment of biofuels is an evolving discipline and will continue to revisit our lifecycle analyses in the future as new information becomes available. EPA plans to ask the National Academy of Sciences for assistance as we move forward. Based on current analyses we have determined that ethanol from corn starch will be able to comply with the required greenhouse gas (GHG) threshold for renewable fuel. Similarly, biodiesel can be produced to comply with the 50% threshold for biomass-based diesel, sugarcane with the 50% threshold for advanced biofuel and multiple cellulosic-based fuels with their 60% threshold. Additional fuel pathways have also been determined to comply with their thresholds. The assessment for this rulemaking also indicates the increased use of renewable fuels will have important environmental, energy and economic impacts for our Nation.
