Available in PDF, EPUB and Kindle. Book excerpt: A standard legal resource since its first edition in 1978, this matchless book has proven itself the ideal overview of Dutch law for foreign lawyers. This Sixth Edition fully updates its systematic description of the legal sources, institutions, and concepts in all major fields of law. Recent developments covered include the progressive implementation of standards set by international conventions, the reorganization of the judiciary, the statute on environmental law, and the (re)codification of private international law. The continuing influence of European law is evident in many fields, perhaps most notably in family law. The various chapters are written by experts – scholars and lawyers – in particular fields, and provide an authoritative overview of each field. The historical sources of Dutch law are discussed, as well as Dutch legal culture, legal philosophy, judicial organization, legal education, and the legal profession. These chapters are followed by introductions to essential issues of private and public law and labour law. The last chapter examines financial law. The only resource of its kind available, this book is unmatched as a thorough guide to further research. It offers practitioners, particularly foreign lawyers, a quick and reliable way into any area of Dutch law that they may be required to research. It will also be of great value to comparatists (especially those studying the influence of European law on national legal systems), scholars, and students. Like previous editions, the Sixth Edition has been prepared under the auspices of the Netherlands Comparative Law Association.

Download or read book Commencement of Insolvency Proceedings written by Dennis Faber and published by OUP Oxford. This book was released on 2012-03-29 with total page 1351 pages. Available in PDF, EPUB and Kindle. Book excerpt: This is the first volume in the new Oxford International and Comparative Insolvency Law Series. The series will provide a comparative analysis of all important aspects of insolvency proceedings and domestic insolvency laws in the main economically developed and emerging countries, starting with the opening of proceedings. This volume addresses the commencement of insolvency proceedings over business debtors and the conditions in which they may arise. It explains the types of proceedings available and the participants involved. The book also analyses the effect of such action on the various players, assets and liabilities concerned. The detail and uniform nature of the treatment of topics helps practitioners to understand specific features of a foreign legal system and effectively brief foreign counsel. For all readers, the book provides access, through analysis in the detailed commentary, to material that was previously only available in a foreign language. Most major legal families (including various mixed legal systems) are covered to reflect the needs of the international insolvency community and intergovernmental organizations. This is the only book that offers a thorough comparative analysis of existing domestic insolvency laws concerning the opening of insolvency proceedings in the main economically developed and emerging countries.

Download or read book A Duty to Resist written by Candice Delmas and published by Oxford University Press. This book was released on 2018-08-01 with total page 288 pages. Available in PDF, EPUB and Kindle. Book excerpt: What are our responsibilities in the face of injustice? How far should we go to fight it? Many would argue that as long as a state is nearly just, citizens have a moral duty to obey the law. Proponents of civil disobedience generally hold that, given this moral duty, a person needs a solid justification to break the law. But activists from Henry David Thoreau and Mohandas Gandhi to the Movement for Black Lives have long recognized that there are times when, rather than having a duty to obey the law, we have a duty to disobey it. Taking seriously the history of this activism, A Duty to Resist wrestles with the problem of political obligation in real world societies that harbor injustice. Candice Delmas argues that the duty of justice, the principle of fairness, the Samaritan duty, and political association impose responsibility to resist under conditions of injustice. We must expand political obligation to include a duty to resist unjust laws and social conditions even in legitimate states. For Delmas, this duty to resist demands principled disobedience, and such disobedience need not always be civil. At times, covert, violent, evasive, or offensive acts of lawbreaking can be justified, even required. Delmas defends the viability and necessity of illegal assistance to undocumented migrants, leaks of classified information, distributed denial-of-service (DDoS) attacks, sabotage, armed self-defense, guerrilla art, and other modes of resistance. There are limits: principle alone does not justify law breaking. But uncivil disobedience can sometimes be not only permissible but required in the effort to resist injustice.

Book Facing the Limits of the Law

Download or read book Facing the Limits of the Law written by Erik Claes and published by Springer Science & Business Media. This book was released on 2009-04-21 with total page 540 pages. Available in PDF, EPUB and Kindle. Book excerpt: Many legal experts no longer share an unbounded trust in the potential of law to govern society efficiently and responsibly. They often experience the 'limits of the law', as they are confronted with striking inadequacies in their legal toolbox, with inner inconsistencies of the law, with problems of enforcement and obedience, and with undesired side-effects, and so on. The contributors to this book engage in the challenging task of making sense of this experience. Against the background of broader cultural transformations (such as globalisation, new technologies, individualism and cultural diversity), they revisit a wide range of areas of the law and map different types of limits in relation to some basic functions and characteristics of the law. Additionally, they offer a set of strategies to manage justifiably law's limits, such as dedramatising law's limits, conceptual refinement ('constructivism'), striking the right balance between different functions of the law, seeking for complementarity between law and other social practices.

Available in PDF, EPUB and Kindle. Book excerpt: A good and proper aristocrat on the isolated, seemingly backward planet of Haven, Genevieve has been carefully instructed in the Covenants -- the ancient, inflexible laws governing the women of her class. She knows what is expected of her: marriage in her mid-twenties to a groom of her father's choosing, childbirth at age thirty. And then soon afterwards -- as has been the lot of so many noblewomen before her -- perhaps death. But there is another Genevieve within who longs to heed the call of the sea -- though she has never once seen the vast waters that cover most of her homeworld's surface. For an unheard voice is crying out to her across the centuries, drawing her ever-closer to a terrible truth hidden beneath a smoke screen of rules, tradition, and propriety. And it is Genevieve who must fulfill a forgotten destiny -- something inborn passed for untold generations from daughter to daughter -- or she and the entire civilization of Haven will be swept away on a cosmic wave of oblivion.

Book In the Interests of Others

Download or read book In the Interests of Others written by Phillip Montague and published by Springer. This book was released on 1992-08-31 with total page 168 pages. Available in PDF, EPUB and Kindle. Book excerpt: Are we morally required to act in the interests of others? Does our worth as persons depend in any way on our valuing the good of others? These questions, illustrative of those addressed in this book, concern the relevance of other-interested considerations -- of facts about what is good or bad for others -- to the moral status of persons and their actions. Pursuing answers to such questions is not only interesting and important in its own right, but also yields valuable insights in to the nature of morality. A distinguishing feature of the book is its unusually comprehensive treatment of the moral significance of other-interested considerations per se, of how these considerations are interrelated, and of where they should be located in more general moral theory. It will be of greatest interest to individuals with fairly well-developed philosophical interests and abilities -- to teachers and advanced students of moral philosophy in particular.
