Book excerpt: The purpose of this paper is to discuss Southeast Asia, U.S. interests, potential threats, and possible challenges/opportunities by which the United States could further its interests in the region. Ten nations make up this region: Burma, Brunei, Cambodia, Indonesia, Laos, Philippines, Malaysia, Singapore, Thailand, and Vietnam. China as an emerging power with interests in the area is also analyzed, even though China is not considered a Southeast Asian nation. The premise is that it is in the United States' vital interests to promote regional stability in the region. Regional stability is best achieved by intertwining economic prosperity and commercial interdependence between the nations of Southeast Asia, the United States, and the international community. Further, it is not considered in the United States' best interests to link commercial and economic engagement to either the specific form of government or human rights issues. It is not suggested that the United States can or should disregard atrocities such as genocide, ethnic cleansing, or other flagrant human rights violations. But the authors would recommend a tempered and balanced approach in evaluating and persuading various nations in the region how to handle internal domestic issues. The United States should continue a policy of constructive engagement using diplomatic, economic, and military instruments of national power to foster democratic principles based on pluralism as well as universal standards of conduct regarding basic human rights. It should be noted that none of the current governments of these 10 nations have found the balance in their democracies that is common in their western counterparts. The governments in these countries are highly autocratic or ethnic-dominated. As a result, successions of power will continue to provide potential periods of instability into the foreseeable future.

Book excerpt: The Association of Southeast Asian Nations (ASEAN) is strategically significant because of its size, dynamism, and role in the Asian economic and security architectures. This paper examines how ASEAN seeks to strengthen these assets through "centrality" in intraregional and external policy decisions. It recommends a two-speed approach toward centrality in order to maximize regional incomes and benefit all member economies: first, selective engagement by ASEAN members in productive external partnerships and, second, vigorous policies to share gains across the region. This strategy has solid underpinnings in the Kemp-Wan theorem on trade agreements. It would warrant, for example, a Trans-Pacific Partnership (TPP) agreement with incomplete ASEAN membership, complemented with policies to extend gains across the region. The United States could support this framework by pursuing deep relations with some ASEAN members, while broadly assisting the region's development.

Forty years of pre-Charter ASEAN practices, coupled with over ten years of post-Charter ASEAN practices thus far, has witnessed the conclusion of hundreds of legally binding regional treaties and similarly binding international instruments in all areas of economic, political-security, and socio-cultural concerns for Southeast Asia to achieve ASEAN’s rule of law-based development objective. Pre-Charter and post-Charter ASEAN Law is variably implemented under a hybrid governance system that depends heavily on ASEAN Member State national implementation alongside ASEAN’s evolving regional institutions. The result is not a model of deep integration as in the case of the European Union, but a particular paradigm of horizontal embeddedness of ASEAN Law – in all its norms and operational practices – contingent on the capacities and compliance of national government bureaucracies in Southeast Asia. This edited collection is a concise authoritative volume covering the practical, doctrinal, legal, and policy aspects of the new regime of ASEAN Law and its consequences for realizing rule of law-based development in Southeast Asia’s emerging single market and production base. Drawing together contributions from a range of key thinkers in the field, the editors present the legal and policy-making issues implicated in the practical implementation of Southeast Asia’s single market and its regime for the free movement of goods, services, foreign investment, and cross-border labor. The United States must now reassess its commitments, and the means and policies it will employ in protecting and promoting national interests in the post-Cold War era. This thesis examines the author's perceived global national interests of the United States in the post-Cold War era, based upon the Preamble of the United States Constitution. United States national interests abroad include protection of American lives and property, economic prosperity, and international goodwill. The perceived national interests of the United States in the East-Asia/Pacific (EA/P) region, with particular emphasis placed on the Southeast Asian sub- region, are discussed. This thesis then examines the political, social, and economic evolution of the Southeast Asian sub-region, including the Association of Southeast Asian Nations (ASEAN), and historical United States national interests in the Southeast Asian sub-region. Past means and policies of the United States to protect and promote its interests in the Southeast Asian sub- region are reviewed. Finally, the opportunities and challenges now facing the United States in devising future means and policies to promote and protect United States national interests, as well as those of other nations, in the EA/P region are explained.
