Book excerpt: Excerpt from Mississippi Law Journal, Vol. 12: October, 1939 Table II shows the disposition of the cases upon appeal and the Justice who wrote the opinion.' Table III is a topical analysis Of the cases, by reference to the Justice writing the opinion. It should be borne in mind while consulting this table that the topic under which a case has been entered is not necessarily the only point involved or decided in the case, but it was necessary in many cases to draw an arbitrary line for the sake of tabulation. Table IV shows the dissents and special concurrences. It is interesting to note that there were approximately five times more dissenting opinions for the last two terms of court than there were for the September 1937, and the March 1938, terms. These tables are published here only with the hope that it may be of interest to the bar and bench of the state. Available in PDF, EPUB and Kindle. Book excerpt: Excerpt from Mississippi Law Journal, Vol. 8: October, 1935 Mr. Martin Members of the Bar of the State of Mississippi, ladies and gentlemen, this is an honor I did not expect when I came up here today. The only thing I can say is I am so glad to see so many of you here, and I trust that this meeting will be a very success ful one, and will make for the upbuilding of law and order, decency and right living in the state of Mississippi. I thank you. (applause.) the president: Ladies and gentlemen, I cannot ref rain, before going further with the program, from an expression of senti ment with reference to this truth and veracity proposition. I am very fearful that if the Clarion Ledger has Charlie Engle as a reverend, it has forever lost its reputation for truth and veracity. Furthermore, I want to say that it is, a fact that when we went to arrange the entertainment here, I had the temerity to suggest that we have a hog-calling contest, and nominated Earl Brewer, Marion Reiley, and Chancellor Amis as principal contestants. Chancellor Amis won a hog-calling contest eighty-two years ago last May. Do you know the blue bloods down at Natchez turned thumbs down on that; they would not care, they said, to hear Marion Reiley calling hogs. N ow, ladies and gentlemen, we come to the President's address. I belong to the Association of Life Insurance Counsel. They met In. New York several years ago. Joe Conwell of the Penn Mutual LI fe Insurance Company, the bad boy of the Association, was there. A distinguished member of that Association had a paper just about that size (indicating the President's address). It was not bradded together, and as he read and finished a page, he put that page at the back, whereupon the irrepressible Conwell said, Please, please, when you have read a page, lay it down on the -table so we will know how far you have gotten and how much further you have to go. If you are commiserating with yourself having to listen to only a part of this paper, just think how much of a burden it was on the man who had to write it. Book excerpt: Excerpt from Mississippi Law Journal, Vol. 7: April, 1935 Marshall's view, which has been consistently followed by the Court, was still more forcefully stated by Justice Gray, considered by some as the most learned in international law of all the jurists who have graced the Supreme Court Bench. In Hilton u. Guyot he said International Law, in its widest and most comprehensive sense part of our law, and must be ascertained and administered by the courts of justice, as often as such questions are presented in litigation between man and man, duly submitted to their determination. It would appear from this con cise statement that the Court recognized the term international law in its comprehensive sense and defined it sufficiently to distinguish it at least from other forms of law applied by the federal courts. Colonies were grouped by religious and national ties, the menace of outside enemies, and economic interdependence. Ethnic and geographic factors accounted for provincialism on the one hand and the unification Of each colony on the other. Such development was natural under the conditions Of transplanting peoples of different political backgrounds in a wilderness. Haddock1 was decided, much has been written' con cerning the jurisdiction of states to grant divorces, and the extent to which such divorces once granted should receive recognition in other states. Lack of agreement has been a principal feature of the writing, and the courts in deciding the cases have emulated the law review writers in that respect at least. The most recent attempt to solve the problem appears in the American Law Institute's Restatement of Conflict of Laws.3 It is possible that the Restatement's solution will put to ultimate rest all the noisy doubts that have beset the legal profession since the Haddock opinion was handed down; or it may not. At any rate, it affords excuse for further discussion. About the Publisher Forgotten Books publishes hundreds of thousands of rare and classic books. Available in PDF, EPUB and Kindle. Book excerpt: Excerpt from Mississippi Law Journal, Vol. 6: Journal of the Mississippi State Bar; April, 1934 In Staley V. Vaughn,18 it was held that homesteads were not included in the exemptions of the Income Tax Law, and there was no Act of Congress adopting the homestead laws of Texas relative to the pay ment of income taxes. As it is not necessary to sue in order to collect income taxes, although that method might be employed, care Should be taken in selecting a method not to run into the reasoning of the fore going case. If a State grants exemptions and exempts the property from taxes, the taxes being a lien, (and such legislation is now being proposed to the Legislatures of some States) the State would be in the same posi tion as the Government now is when it relegates its tax to mortgages. If the state tax is not subordinate to exemptions, of course, the federal tax is not; but there is the difference that the state fixes a status in the spouse, or head of a family, and the subsequent federal tax claim against one spouse might not effect the rights of the other.
