A forum in which matters peculiarly of interest to the lawyers and law students may find expression. It is true the bar of the state and the law students have had the benefits of great law journals, such as the American Bar J ournal and others of like nature, but these publications do not and can not take care of the local needs. One feature of the journal which should appeal to the bar will be the publication of the annotations of our decisions and statutes to the re-statement of the common law by the American Law Institute. A committee was ap pointed by the Bar Association at the Gulfport meeting charged with the duty of working out some plan where by our decisions and statutes might be annotated to thelaw as restated by the American Law Institute. The com mittee has been able to procure Chief J ustice Sidney Smith and Honorable George Butler of the J ackson Bar, together with members of the law faculty, to annotate our decisions and statutes to the subjects of the law already restated and those subjects partially restated by the American Law In stitute, namely, Conflict of Laws, Torts, Contracts, and Criminal Law. This feature of the journal alone should be of great value to the bar in Mississippi, especially, since the Mississippi Supreme Court will cite the re-statement of the law, (b) it will open a forum for the student of law who is not in the active practice, both in and out of the law school, for the discussion of timely and pertinent legal questions, together with comments on and criticisms of cases and questions of law passed upon by the Mississippi courts. So spoke Lord Nottingham in the Duke of Norfolk's Case1 two hundred and fifty years ago when he decided that no public policy forbade limiting a term on a term within the space of a life in being. In the period since Lord Nottingham's decision com mon' law courts have examined many limitations in a search for such visible inconveniences as the learned Lord Chancellor had in mind. Some dispositive provisions have been held to violate sound public policy and others have been upheld in the belief that they were not dangerous. What is today known as the Rule against Perpetuities is but a synthesis of such decisions. However, with the emergence of the Rule there has been a change Of emphasis. Courts no longer find it necessary to feel their way along as did Lord Nottingham: limitations are not tested to see whether they violate broad considerations of public policy. Particularized con siderations have given way to the single question of whether the Rule against Perpetuities is violated. John Chipman Gray spoke strongly as a champion of this codification. The Court held that the defendant could have the exam ination under such reasonable restrictions as the court might require. The request for such an examination naturally comes during the progress of the trial because it can be made only after the plaintiff has exhibited the injured parts of his body to the jury. Some examinations, in order to be of value, might require considerable time. Some might require that the plaintiff be kept under Observation for considerable time. The ques tion is as to how long the trial judge would be willing to suspend the trial while the examination is being made. Furthermore, the question might frequently arise as to whether the plaintiff has voluntarily exhibited the injured portions of his body to the jury. If he does not do so during examination by his own counsel, but makes such exhibition at the request of the cross-examiner, has he done SO voluntarily? Ranney surveys the evolution of Mississippi’s legal system and analyzes the ways in which that system has changed during the state’s first two hundred years. Through close research, qualitative analysis, published court decisions, statutes, and law review articles, along with unusual secondary sources including nineteenth-century political and legal journals and journals of state constitutional conventions, Ranney indicates how Mississippi law has both shaped and reflected the state’s character and, to a certain extent, how Mississippi’s legal evolution compares with that of other states. Ranney examines the interaction of Mississippi law and society during key periods of change including the colonial and territorial eras and the early years of statehood when the legal foundations were laid; the evolution of slavery and slave law in Mississippi; the state’s antebellum role as a leader of Jacksonian legal reform; the unfolding of the response to emancipation and wartime devastation during Reconstruction and the early Jim Crow era; Mississippi’s legal evolution during the Progressive Era and its legal response to the crisis of the Great Depression; and the legal response to the civil rights revolution of the mid-twentieth century and the cultural revolutions of the late twentieth century. Histories of the law in other states are starting to appear, but there is none for Mississippi. Ranney fills that gap to help us better understand the state as it enters its third century.
