Book excerpt: The First Amendment of the U.S. Constitution provides the freedom to individuals to exercise their religious beliefs without governmental interference, and simultaneously prohibits government actions that benefit followers of one faith over another. At times, when government actions would otherwise burden individuals' religious exercise, the government makes efforts to accommodate the religious practice. However, accommodation of religion to prevent violations of the Free Exercise Clause must be carefully considered in order to prevent violation of the Establishment Clause. The tension between the clauses has been illustrated in a number of military scenarios in recent years. This report provides an overview of the requirements of the First Amendment related to military personnel's religious exercise. It analyzes current constitutional and statutory requirements regarding religious exercise, and provides a framework for how Congress and the courts might consider future issues that arise related to servicemembers' religious exercise. Specifically, the report examines the limitations placed on servicemembers in uniform in the exercise of their religious beliefs. It also examines the role of military chaplains and the legal challenges associated with publicly funding religious personnel. The report analyzes efforts by Congress and the Dept. of Defense (DOD) to address the constitutional concerns that are raised by these issues. This is a print on demand report.

Book excerpt: Today, the subcommittee will examine religious accommodations in the armed services, including the military services' interpretation, enactment, and enforcement of religious accommodation statutory and regulatory guidance. Historically, the armed services have supported religious freedom and, when possible, accommodated service members' religious beliefs and practices. Maintaining a proper balance between religious accommodations will promote military readiness, unit cohesion, and good order and discipline. This should not present challenges to the military services. Chaplains have always been vital to our military. One of the strengths of our military is its diversity with mutual respect. And as such, it has been important for Congress to work with the Department of Defense to ensure that appropriate statutory and regulatory guidance is in place in order for the services to meet the important spiritual and religious needs of our troops. Recognizing that there have been challenges in accommodating religious practices and beliefs, we have engaged in various efforts to clarify the role of religion in the military, prevent religious discrimination, and provide appropriate religious accommodations for those service members who seek it. Our goal today is to better understand how the Department of Defense has balanced the implementation of the religious accommodations policy with maintaining military readiness, unit cohesion, and good order and discipline.

Some examples: Religion and the Military: A Growing Ethical Dilemma - Ethical dilemmas over the issue of freedom of personal religious expression and fair treatment for all faith groups are creating conflicts within the military, both inside and outside the chaplaincies. A lawsuit filed by a group of Navy chaplains, alleging discrimination by the Chaplain Corps on the basis of their religion, is currently making its way through the courts. Recently, a few senior officers at the Air Force Academy were accused of using their position to inappropriately propagate Christian views. Given the fact that non-Judaeo-Christian religious groups are proliferating in the military, it is likely that such conflicts will continue to occur absent an intentional strategy to address this issue. This SRP will review the history of this growing dilemma and recommend ways to address it in a way that is not only fair to all concerned but upholds the American tradition of tolerance toward all religious groups and contributes to a positive command climate. The young man who knocked on my door and asked, somewhat hesitantly, "Got a minute, chaps?" seemed at first like so many others who want to talk to a chaplain but are reluctant to do so. I invited him to sit down and tell me what was on his mind. His question was one I did not anticipate. In retrospect, however, this was one of the more honest and memorable conversations I have had during my 19-plus years as a Navy chaplain. He asked, "With all due respect, sir, what am I as an atheist supposed to do when you offer a public prayer during a command function? I can't leave, and if I bow my head and participate I feel that I am being hypocritical. What do I do?" Combatant Commander Challenges and the Role of Religion and History - The challenges posed to the Commandant Commander (CCDR) in conducting operations can be captured in a thorough understanding of Joint Publication 5-0, which provides a checklist of inputs to the design, but is wanting on two key issues. First, the doctrine glosses over the significance of history by simply adding the adjective of "relevant" before the term "history". Instruments of Peace: This research project explores the extent to which religious leadership factors and actors play constructive roles in preventing war. My interest in this topic is directly related to my dual professional posture in the military. My ordination as an Elder in the African Methodist Episcopal Zion Church affirms and endorses me to serve as a commissioned chaplain in the U.S. Air Force. As a chaplain, my primary tasks involve: 1) ensuring that members understand the nature of and have full opportunity for the free exercise of religion; and 2) providing pastoral and spiritual care to members and their families.

Watchdog groups, like Military Religious Freedom Foundation, are increasingly using media and litigation to challenge religious expression within the military. While the USAF must carefully investigate all cases for legitimacy, the USAF and DOD must avoid over-reacting to the deafening noise of media and litigation pressures while carefully protecting religious expressions as protected by the Free Exercise and Speech clauses. Most importantly, the USAF and DOD must not confuse offense as coercion or undue influence. To create restrictive guidance or policy on the potential of offense does not offset the constitutional freedom of religious expression and speech. Using whether or not one was offended to determine religious coercion is a faulty, woefully deficient proposition and must be avoided. Finally, this paper proposed several recommendations for both the Chaplain Corps and commanders as too much is at stake to ignore these issues. Book excerpt: "The purpose of this research paper is to determine what policy changes are necessary for the Air Force to better protect religious expression while neither censoring nor "establishing a religion" in violation of the First Amendment of the U.S. Constitution. The research methodology used here is a problem/solution framework to determine what characteristic of neutrality towards religion the Air Force should adopt that provides the best solution for upholding the protections of the Establishment and Free Exercise Clauses. The paper's findings include that "strict neutrality," which demands a total separation between church and state, is unworkable and renders religious expression susceptible to violations of the Free Exercise Clause. The paper also finds that "benevolent neutrality," a position more accommodating toward religious expression, protects the free exercise of religion without violating the Establishment Clause. The recommendations include having Air Force Instruction (AFI) 1-1 define "religion" consistently with AFI 36-2706, adding language to AFI 1-1 that states that religious expression does not inherently cause an adverse impact, and requiring Air Force leaders to avoid the use the their positions for to coerce subordinates, or show preferential treatment in the direction of a particular religion"--Abstract.
