Par ailleurs, un nouvel environnement se dessine dans le monde du travail, avec l'arrivée de nouvelles technologies, de normes de travail différentes, l'augmentation des activités économiques indépendantes, et une plus grande flexibilité en matière de temps de travail et de pratiques sur le lieu de travail. Pour cette raison, certains pays européens ont adopté de nouvelles lois et de nouvelles politiques pour attirer les ouvriers étrangers hautement ou moyennement qualifiés. Cependant, les nouvelles mesures peuvent mettre en danger certains acquis dans ce domaine et peuvent ne pas être en accord avec les normes du Conseil de l'Europe visant à garantir les droits des travailleurs migrants, tels que la Charte sociale européenne et la Convention européenne relative au statut juridique du travailleur migrant. Cette étude se concentre sur les règles concernant le statut juridique des principales catégories de travailleurs migrants admis aux fins d'un emploi dans certains Etats membres du Conseil de l'Europe. L'étude examine la question essentielle de savoir si ces règles nationales sont conçues de manière à aider les migrants à s'intégrer dans le pays d'accueil, en leur garantissant un statut de résidence stable et l'accès aux droits sociaux, ou si elles découragent ou même empêchent une telle intégration.

Il met en évidence une stratification de la population active et brosse ainsi un tableau des différents modes d'intégration. Nombre de personnes appartiennent à un salariat précaire, qui exerce de plus en plus souvent dans les commerces ou les services ; et plusieurs formes de mobilité sociale sont apparues. Cependant, l'emploi de femmes, élément essentiel de flexibilité, reste concentré dans un petit nombre d'activités. Un regard historique sur la constitution de la population active en France au cours de la seconde moitié du 20e siècle fait apparaître, parmi d'autres phénomènes majeurs, l'arrivée sur le marché du travail de vagues successives d'immigrants. La prise en compte de la présence féminine dans les courants migratoires - si on ne la cantonne pas au seul rôle familial - modifie la perspective des recherches dans ce domaine. L'entrée en activité progressive des femmes immigrées favorise un processus d'assimilation, un accès à l'autonomie de ces femmes, ainsi qu'une remise en question des " valeurs traditionnelles " du groupe.

Labor Movement suggests that the international migration of workers is necessary for the survival of industrialized economies. The book thus turns the conventional view of international migration on its head: it investigates how migration regulates labor markets, rather than labor markets shaping migration flows. Assuming a critical view of orthodox economic theory, the book illustrates how different legal, social and cultural strategies towards international migrants are deployed and coordinated within the wider neo-liberal project to render migrants and immigrants vulnerable, pushing them into performing distinct economic roles and into subordinate labor market situations. Drawing on social theories associated with Pierre Bourdieu and other prominent thinkers, Labor Movement suggests that migration regulates labor markets through processes of social distinction, cultural judgement and the strategic deployment of citizenship. European and North American case studies illustrate how the labor of international migrants is systematically devalued and how popular discourse legitimates the demotion of migrants to subordinate labor. Engaging with various immigrant groups in different cities, including South Asian immigrants in Vancouver, foreigners and Spätaussiedler in Berlin, and Mexican and Caribbean offshore workers in rural Ontario, the studies seek to unravel the complex web of regulatory labor market processes related to international migration. Recognizing and understanding these processes, Bauder argues, is an important step towards building effective activist strategies and for envisioning new roles for migrating workers and people. Immediate action is needed because the status quo risks causing permanent damage to the development prospects of those countries. The AMCs' public policies are currently ill equipped to face the challenge. Labor migration remains a key feature of the labor markets in these countries - yet cannot by itself solve the labor market challenges there. The study makes a number of recommendations including: upgrading the statistics available and conducting further in-depth analysis; upgrading education and training systems; mainstreaming the policy goal of job creation and higher productivity; promoting active labor market policies; creating incentives to hire new graduates and women; creating incentives to transform informal into formal employment; and establishing social protection systems guaranteeing universal coverage, with the emphasis on worker rather than job protection. It also recommends that the EU upgrade its existing framework for AMC migration not only as a unilateral strategy, but as a cooperative framework for true co-development.--Publisher's description.
