In the 1990s a series of high-profile anti-sweatshop and fair-trade campaigns shifted the spotlight to labor issues. But as human rights activists in the United States and elsewhere take up the cause of economic exploitation, they don't always agree on the nature of the problem, or on what should be done to address it. What is more, they do not necessarily have the final say: in many cases, the focus of a campaign will shift when local activists make their voices heard or when the imported aims of nongovernmental organizations conflict with the goals of the people they intend to help. Shareen Hertel explores the dramatic negotiations within cross-border human rights campaigns. Activists on the receiving end of such campaigns do much more than seek the help of powerful allies beyond their borders. They often also challenge outsiders' understandings of basic human rights—in some cases, directly (by "blocking" campaigns intended to help them) and in other cases, indirectly (by employing "backdoor moves" aimed at more subtly introducing new human rights norms). Hertel looks closely at struggles for human rights in two contexts: Bangladesh, where activists challenged the understanding of human rights central to an international campaign to prevent child labor in that country, and Mexico, where activists sought to broaden the scope of efforts to prevent discrimination against pregnant workers in their country. Hertel connects these unexpected challenges to a new wave of international advocacy, and thereby illuminates democratic struggles in the new global economy.

Book excerpt: Assessing the effectiveness of the North American Agreement on Labour Cooperation (NAALC), this book examines the operation of the core institutions (the Secretariat and National Administrative Offices) over the past seven years. It discusses the main functions of these institutions in hearing public submissions on violations of labour laws and in conducting research and cooperative activities. Based on interview research, the analysis reviews the strengths and weaknesses of the accord to assess its contribution to a common labour relations regime in North America and its impact in creating new transnational communities of actors in government and civil society in the three countries. The NAALC is also compared with the social dimension of the European Union system, and a final assessment is made as to whether the NAALC institutions live up to the promises of their founders and whether these can be a model for labour relations in any future Free Trade Area of the Americas (FTAA) agreement.

Book excerpt: Prior to the millennium, economists and policy makers argued that free trade between the United States and Mexico would benefit both Americans and Mexicans. They believed that NAFTA would be a “win-win” proposition that would offer U.S. companies new markets for their products and Mexicans the hope of living in a more developed country with the modern conveniences of wealthier nations. Blending rigorous economic and statistical analysis with concern for the people affected, Mexican Women in American Factories offers the first assessment of whether NAFTA has fulfilled these expectations by examining its socioeconomic impact on workers in a Mexican border town. Carolyn Tuttle led a group that interviewed 620 women maquila workers in Nogales, Sonora, Mexico. The responses from this representative sample refute many of the hopeful predictions made by scholars before NAFTA and reveal instead that little has improved for maquila workers. The women’s stories make it plain that free trade has created more low-paying jobs in sweatshops where workers are exploited. Families of maquila workers live in one- or two-room houses with no running water, no drainage, and no heat. The multinational companies who operate the maquilas consistently break Mexican labor laws by requiring women to work more than nine hours a day, six days a week, without medical benefits, while the minimum wage they pay workers is insufficient to feed their families. These findings will make a crucial contribution to debates over free trade, CAFTA-DR, and the impact of globalization.

Human rights activists increasingly address the activity of multinational corporations, the policies of international organizations such as the World Bank and the World Trade Organization, and international crimes committed by entities such as armed opposition groups and terrorists. This book presents an approach to human rights that goes beyond the traditional focus on states and outlines the human rights obligations of non-state actors. Furthermore, it addresses some of the ways in which these entities can be held legally accountable for their actions in various jurisdictions. The political debate concerning the appropriateness of expanding human rights scrutiny to non-state actors is discussed and dissected. For some, extending human rights into these spheres trivializes human rights and allows abusive governments to distract us from ongoing violations. For others such an extension is essential if human rights are properly to address the current concerns of women and workers. The main focus of the book, however, is on the legal obligations of non-state actors. The book discusses how developments in the fields of international responsibility and international criminal law have implications for building a framework for the human rights obligations of non-state actors in international law. In turn these international developments have drawn on the changing ways in which human rights are implemented in national law. A selection of national jurisdictions, including the United States, South Africa and the United Kingdom are examined with regard to the application of human rights law to non-state actors. The book's final part includes suggestions with regard to understanding the parameters of the human rights obligations of non-state actors. Key to understanding the legal obligations of non-state actors are concepts such as dignity and democracy. While neither concept can unravel the dilemmas involved in the application of human rights law to non-state actors, a better understanding of the tensions surrounding these concepts can help us to understand what is at stake.
