The increase in levels of educational attainment is associated in some cases with an alarming rate of unemployment among those with academic qualifications, while employers encounter considerable difficulty in recruiting workers for unskilled and semi-skilled positions. The economies of developing countries, on the other hand, are characterized by different trends, reminiscent of the early stages of modern labour law, with the large-scale exploitation of young workers and children, many of whom join the flow of migrants towards the more highly developed regions of the world, with the consequent risk of impoverishing human capital in the country of origin. It draws on neo-constitutional theories and builds on the assumption that fundamental labour rights, understood as rights aimed at protecting workers during their working life or after retirement, are the normative expression of founding values and can be balanced against equally axiological constitutional principles. The balancing of constitutional labour rights can be conducted by various institutional actors and by applying different techniques. This volume reviews the theoretical debates on judicial balancing and the approaches adopted by the Court of Justice of the European Union and the European Court of Human Rights, to proceed with a closer assessment of Italian and Spanish judicial traditions. In particular, it addresses the main profiles of the case law of the Italian and Spanish Constitutional Courts on labour and social law reforms adopted in the aftermath of the 2008 crisis, where balancing takes place between labour rights and economic principles. The analysis is focused on four main aspects: the fundamental labour rights in the balance; the role of the Courts; the technique applied by the Judges; and the constitutional interests subject to the balancing. It ultimately reveals that the axiological nature of fundamental labour rights is preserved and the economic and financial contingencies confirm their factual character, although they are occasionally recognised a prominent role in the ratio decidendi. Eloisa Betti’s monograph convincingly demonstrates on the example of Italy that even in the post-war phase of Keynesian stability and welfare state, precarious labor was an underlying feature of economic development. She examines how in this short period exceptional politics of labor stability prevailed. The volume then presents the processes whereby labor precarity regained momentum— under the name of flexibility— in the post-Fordist phase from the early 1980s, taking on new forms in the Craxi and Berlusconi eras. Multiple actors are addressed in the analysis. The book gives voice to intellectuals, scholars, politicians and trade unionists as they have framed the concept and debates on precarious work from the 1950s onwards. Views of labor law experts, politicians and public servants are investigated in regard to labor regulations. Positions of the very precarians are explored, ranging from rural women, industrial homeworkers and blue-collar workers to physicians, university researchers and trainees, unveiling the emergence of anti-precarity social movements. The continuous role of women’s associations and feminist groups in opposing labor precarity since the 1950s is prominently exposed.

Book excerpt: Guaranteeing third country national workers robust equal treatment with regard to working conditions and pay is a crucial condition for avoiding social dumping, exploitation, and other reasons for regime shopping within the EU. However, Member States are still reluctant to compromise control of their borders and their labour markets. The EU legislation adopted is, as a result, fragmented and full of solutions that give Member States an extensive margin of room for manoeuvre. In this book six distinguished European labour law academics discuss how three EU directives on labour migration – the Single Permit Directive, the Blue Card Directive, and the Directive on Seasonal Employment – interact with the labour migration systems of France, Germany, Italy, Poland, and Sweden – five countries with very different characteristics and approaches to implementation. Concrete issues dealt with in each country include the following: – conditions for granting work permits; - reasons for withdrawing a work permit; - how long a migrant worker can stay; - whether a migrant worker can bring his or her family; - employment and labour rights of migrant workers; - migrant workers' access to social rights; - how a migrant worker may enforce rights; - sanctions for violations of applicable provisions; and - potential for permanent status for a migrant worker. For each of these issues the authors analyse to what extent national legislators have been ready to adapt their national systems in order to fulfill the aims of the EU directives. They also identify unintended, or at least not explicit, effects of the implementation process. The authors clearly reveal whether the ambitions of the EU when initiating this process can be detected in the implementation process, and how implementation of the three directives have changed and could change national law on these issues. As the first in-depth analysis of how the intersection of migration and labour law and their impact on labour and employment relations play out in the EU context this book brings important insights to the growing literature in this field. Book excerpt: The insertion in June 1997 of a Title on employment in the Treaty on European Union has accelerated the drafting of European policy in this field over the last few years. This European dynamic has had widespread impact on the themes and mechanisms that characterise national systems of industrial relations. On the one hand, employment is increasingly governed by rules negotiated between the social partners and, depending on the circumstances, the State. This phenomenon of joint labour market regulation is confirmed by a marked desire on the part of employers' associations and trade unions to integrate employment-related issues into their actions and negotiations. On the other hand, the incorporation of employment-related themes by employers’ associations and trade unions, usually in concertation with government policies, is related with greater coordination of bargaining and concertation mechanisms established at European level and within each Member State. Today, the various national realities appear to be directed to various degrees by these two general tendencies. These phenomena active in the field of employment bargaining must therefore be analysed on three counts: the first focuses on the development of the coordination mechanisms that structure these negotiations, and more specifically raises the issue of co-responsibility for the labour market; the second deals with the strict content of employment bargaining, and examines the question of negotiated flexibility of working conditions and employment; the third addresses the autonomy of collective bargaining in Europe. This analysis informs our research, which is in turn intimately linked to recent changes taking place in national systems of industrial relations.

Book excerpt: The sharing economy is just one of several possible expressions to designate the complex model of social and economic relationships based on the intensive use of digital technology. Constant permutations and combinations allow these relationships to be established through the intervention of a third party making traditional contractual positions flexible in such a way that today’s employee is tomorrow’s entrepreneur, or today’s consumer is tomorrow’s supplier of goods and services. The current legal framework is, in many respects, unable to accommodate such big changes and new legal regulations are required where adaptation of the existing ones proves to be inadequate. This book highlights where changes are needed and where adaptations are required, with a particular focus on the Portuguese, Spanish, Italian, British and Brazilian contexts. For that, four different approaches are undertaken, namely the meta-legal, macro-legal, micro-legal and transnational approaches. The study that results from these different approaches enables readers to acquire a general view on the current legal problems arising from the sharing economy, and was a direct result of a research project of the Centre for Legal and Economic Research, at the University of Porto, funded by Fundação para a Ciência e Tecnologia.

Recent changes in technology and the global economy, however, have dramatically eroded this traditional form of employment.
