Book excerpt: Non-tariff measures are generally defined as policy measures other than ordinary customs tariffs that can potentially have an economic effect on international trade in goods, changing quantities traded, or prices or both. Since this definition is broad, a detailed classification is of critical importance so as to better identify and distinguish among the various forms of non-tariff measures. The classification of non-tariff measures presented here is a taxonomy of all those measures considered relevant in international trade today. It builds on an old UNCTAD classification known as the Coding System of Trade Control Measures and was developed by several international organizations forming what is called the MAST group (Multi-Agency Support Team) set up to support the Group of Eminent Persons on Non-tariff Barriers established by the Secretary General of UNCTAD in 2006. The MAST team discussed and proposed this classification, and is composed of: FAO, IMF, ITC, OECD, UNCTAD, UNIDO, World Bank and WTO. The classification is seen as evolving and should adapt to the reality of international trade and data collection needs.

This study assesses currently available methods for quantifying such barriers and makes recommendations as to those methods that can be most effectively employed. The authors focus both on the conceptual issues arising in the measurement of the different types of nontariff barriers and on the applied research that has been carried out in studies prepared by country members of the OECD Pilot Group and others seeking to quantify the barriers. Nontariff barriers include quotas, variable levies, voluntary export restraints, government procurement regulations, domestic subsidies, and antidumping and countervailing duty measures. These non-tariff barriers have become the focus of trade disputes, negotiations, and agreements. This book explains the dynamics of conflict and cooperation over consumer and environmental regulation between the European Union and the United States. It explores the most celebrated cases of transatlantic conflicts over regulatory standards—the EU's beef hormone and legtrap bans, and America's fuel economy regulations—as well as the successes of the two partners in coordinating rules for chemical and drug testing, animal inspection, and the reduction of ozone-depleting chemicals. David Vogel argues that transatlantic regulatory conflict has less to do with protectionism and more to do with deeply rooted differences in cultural values and political priorities in Europe and the United States. These differences, he explains, constitute a fundamental and ongoing source of trade conflict between the EU and the U.S. The pattern of EU-U.S. regulatory relations has important implications, not only for the United States and Western Europe, but for the entire global economy. Whatever regulatory standards both adopt become de facto global standards. According to Vogel, the most important challenge for the U.S. and the EU is to promote and strengthen international regulatory cooperation. Each needs to pay more attention to their common interests in promoting international trade and improving global standards than to their often heated differences over particular consumer and environmental policies.
