No lawyer practicing in Maryland can afford to practice in Maryland without having a copy of this book. In addition, because the Maryland central panel approach has been adopted by over half the states and the District of Columbia, this book is a useful tool for lawyers outside of Maryland. This treatise discusses in detail the administrative process at the state and county levels in Maryland. It includes discussion of topics such as rulemaking, contested cases, judicial review, and separation of powers. Most significantly, it includes a detailed discussion of the central panel approach followed by Maryland's Office of Administrative Hearings which is a model for central panels across the country. Because Maryland cases have been influential in other states, this book is valuable in states with central panels. For example, Maryland's highest court's opinion halting the death penalty because of a Maryland agency's failure to adopt proper regulations to administer the lethal injection was followed in Kentucky. This treatise is written by a law professor with thirty years of experience teaching Federal Administrative Law and State Administrative Law courses. Principles and Practice of Maryland Administrative Law is one of a handful of books which focus on the state administrative process and will be very helpful to understanding state administrative law across the country.

Subsequently, Congress enacted statutes federalizing what had been solely state crimes, thereby establishing federal court and state court concurrent jurisdiction over these crimes. Federalization of state crimes has been criticized by numerous scholars, U.S. Supreme Court justices, and national organizations. Such federalization has congested the calendars of the U.S. District Court and the U.S. Court of Appeals leading to delays in civil cases because of the Speedy TrialAct that vacates a criminal indictment if a trial is not commenced within a specific number of days, resulted in over-crowded U.S. penitentiaries, and raises the issue of double jeopardy that is prohibited by the Fifth Amendment to the U.S. Constitution and the constitution of each state. This book examines the impact of federalization of state crime and draws conclusions regarding its desirability. It also offers recommendations directed to Congress and the President, one recommendation direct to state legislatures for remedial actions to reduce the undesirable effects of federalized state crimes, and one recommendation that Congress and all states enter into a federal-interstate criminal suppression compact.

Jacob Lumbrozo, a Maryland Jew who suggested Christ's miracles were done by "magic," was imprisoned indefinitely, escaping execution only by the governor's pardon. Rebecca Fowler was accused of using witchcraft to cause her Calvert County neighbors to feel "very much the worse;" she was hanged on October 9, 1685. Mrs. Thomas Ward whipped a runaway maidservant with a peachtree rod, then rubbed salt into the girl's wounds; the girl died, and Mrs. Ward was fined three hundred pounds of tobacco. Now available in a new paperback edition, Raphael Semmes's classic Crime and Punishment in Colonial Maryland contains a wealth of colorful—though often disturbing—details about the law and lawbreakers in 17th-century Maryland. Semmes explains, for instance, that theft was rare among early Marylanders—if only because the colonists had little worth stealing. But what the colonists valued, they endeavored to protect: A 1662 law punished a person twice-convicted of hog-stealing by branding an "H" on his shoulder. (Widely perceived as being too lenient, the law was amended four years later: first offense, "H" on the forehead.) Men caught in adultery were often fined; women were often whipped. And knowing how to swim was so rare among 17th-century women that suggesting one could do so was tantamount to accusing her of witchcraft: a minister's son who claimed as much was sued by the woman for defamation of character. Crime and Punishment in Colonial Maryland offers fascinating and detailed case histories on such crimes as theft, libel, assault and homicide, as well as on adultery, profanity, drunkenness, and witchcraft. It also explores long-forgotten aspects of old English law, such as theftbote (an early form of "victim compensation"), deodand (an animal or article which, having caused the death of a human being, was forfeited to the Crown for "pious uses"), and the blood test for murderers.

Planning for resource allocation is one of the most important functions that a criminal justice agency performs. The 1968 Omnibus Crime Control and Safe Streets Act required the creation of state criminal justice planning agencies and the development of annual state comprehensive plans as a contingency for state participation in federal criminal justice funding. In the initial section of this volume, the National Advisory Commission points out the need for additional planning at the metropolitan and regional levels, and indicates the necessity for quantifying performance objectives. It also stresses participation in the planning process by criminal justice agencies, government departments and private citizens. The Commission recommends the development of state integrated multiyear planning and the establishment of criminal justice coordinating councils by all major cities and counties. Other areas of concern to the Commission, in addition to management and budget planning, include systems analysis, information systems, evaluation, personnel training, and criminal code revision. These and other commission proposals appear in the form of specific standards and recommendations -- nearly 70 in all -- that spell out in detail what the segments of the criminal justice system-the police, courts, and correctional agencies can do to upgrade and modernize many of their functions. This manual is a reference work for the practitioner as well as the interested layman.
