Book excerpt: Based on the sensitivity of the European Financial Markets highlighted by the last financial crisis, the European Union is pushing for reforms of the existing regulatory framework and has also proposed a Financial Transaction Tax. Until now, the European Union has already adopted a Regulation on short selling and certain aspects of credit default swaps and a European Market Infrastructure Regulation aiming at over-the-counter derivatives markets. It currently debates reforming the Markets in Financial Instruments Directive and adopting a Markets in Financial Instruments Regulation and a Regulation on Central Securities Depositories. This strand of financial market regulation shall be complemented by a Financial Transaction Tax pushed forward through the enhanced cooperation mechanism.This article analyses the interplay between the financial market regulation, including the European Union's reform proposals, and the proposed Financial Transaction Tax. The authors will conclude that both strands of financial market regulation are not sufficiently coordinated.

Book excerpt: The financial crisis has generated a high degree of legislative activity both in the area of substantive and procedural financial regulation and in the area of taxation of the financial sector. This article explores criteria for legislative choice (in particular for the European Union) when a given target can be addressed both by regulatory means and by fiscal burdens. Major examples include the (1) choice between capital requirements for financial institutions and the introduction of bank levies, (2) substantive constraints for executive compensation versus a “bonus tax”, and (3) the relationship between the existing European regulatory regime of financial markets and the current project of a “financial transaction tax”. While bank levies can play a meaningful role alongside capital requirements, both the “bonus tax” and the “financial transaction tax” seem less attractive than alternative regulatory options.

One variation is a tax on all foreign currency conversions, often termed a “Tobin tax.” This paper suggests that these taxes would probably not produce the desired effects and would be difficult to design and implement. It is unclear that the possible advantages in reducing some short-term speculative trading would outweigh the possible disadvantages in impairing the efficiency of financial markets. From an administrative perspective, without a broad international consensus and application, these taxes are likely to be easily avoided.
