Book excerpt: EL BINOMIO marcas y distribución comercial constituye uno de los pilares fundamentales del llamado Derecho de la Distribución Comercial. En una situación de mercados globalizados y de fuerte competencia los contratos de distribución permiten a los fabricantes o proveedores la creación de redes de distribuidores para facilitar la comercialización uniforme de sus prestaciones, potenciando su imagen como empresario y la de sus productos o servicios. En este contexto la marca adquiere un papel fundamental, pues sirve para identificar y distinguir en el mercado los productos o servicios de un empresario frente a otros iguales o similares de terceros, facilitando así la elección de los consumidores, y además proyecta la imagen del proveedor en el mercado a través de sus distribuidores, que vienen obligados al uso de la marca en su actividad de reventa de los productos y prestación de servicios, aportando confianza a los destinatarios sobre el origen empresarial de esas prestaciones y sobre el conocimiento específico de las mismas por parte de los distribuidores a la hora de informar y solucionar posibles problemas. Pero no son extraños los casos en que la marca es utilizada por terceros no autorizados para dar cobertura a su propia actividad de distribución de originales o meras imitaciones de los productos o servicios del proveedor. Esta obra, primera en nuestro país que aborda esta problemática con carácter monográfico, pretende dar respuesta a los muchos problemas que el registro y uso de marcas provoca en el sector de la distribución comercial, tanto en las relaciones del proveedor con sus distribuidores autorizados como en los conflictos entre proveedor y terceros ajenos a su red de distribución, sin olvidar las consecuencias que estas disputas pueden tener para los intereses de consumidores y usuarios.
