Book excerpt: This book deals with sentencing in international criminal law, focusing on the approach of the UN ad hoc Tribunals for the former Yugoslavia (ICTY) and Rwanda (ICTR). In contrast to sentencing in domestic jurisdictions, and in spite of its growing importance, sentencing law is a part of international criminal law that is still 'under construction' and is unregulated in many aspects. International sentencing law and practice is not yet defined by exact norms and principles and as yet there is no body of international principles concerning the determination of sentence, notwithstanding the huge volume of sentencing research and the extensive modern debate about sentencing principles. Moreover international judges receive very little guidance in sentencing matters: this contributes to inconsistencies and may increase the risk that similar cases will be sentenced in different ways. One purpose of this book is to investigate and evaluate the process of international sentencing, especially as interpreted by the ICTY and the ICTR, and to suggest a more comprehensive and coherent system of guiding principles, which will foster the development of a law of sentencing for international criminal justice. The book discusses the law and jurisprudence of the ad hoc Tribunals, and also presents an empirical analysis of influential factors and other data from ICTY and ICTR sentencing practice, thus offering quantitative support for the doctrinal analysis. This publication is one of the first to be entirely devoted to the process of sentencing in international criminal justice. The book will thus be of great interest to practitioners, academics and students of the subject.

For early modern people on both sides of the Atlantic, writing was also the province of notaries, men trained to cast other people’s words in official forms and make them legally true. Thus the first thing Columbus did on American shores in October 1492 was have a notary record his claim of territorial possession. It was the written, notarial word—backed by all the power of Castilian enforcement—that first constituted Spanish American empire. Even so, the Spaniards who invaded America in 1492 were not fond of their notaries, who had a dismal reputation for falsehood and greed. Yet Spaniards could not do without these men. Contemporary scholars also rely on the vast paper trail left by notaries to make sense of the Latin American past. How then to approach the question of notarial truth? Kathryn Burns argues that the archive itself must be historicized. Using the case of colonial Cuzco, she examines the practices that shaped document-making. Notaries were businessmen, selling clients a product that conformed to local “custom” as well as Spanish templates. Clients, for their part, were knowledgeable consumers, with strategies of their own for getting what they wanted. In this inside story of the early modern archive, Burns offers a wealth of possibilities for seeing sources in fresh perspective.

Book excerpt: The contributions of the black population to the history and economic development of Puerto Rico have long been distorted and underplayed, Luis A. Figueroa contends. Focusing on the southeastern coastal region of Guayama, one of Puerto Rico's three leading centers of sugarcane agriculture, Figueroa examines the transition from slavery and slave labor to freedom and free labor after the 1873 abolition of slavery in colonial Puerto Rico. He corrects misconceptions about how ex-slaves went about building their lives and livelihoods after emancipation and debunks standing myths about race relations in Puerto Rico. Historians have assumed that after emancipation in Puerto Rico, as in other parts of the Caribbean and the U.S. South, former slaves acquired some land of their own and became subsistence farmers. Figueroa finds that in Puerto Rico, however, this was not an option because both capital and land available for sale to the Afro-Puerto Rican population were scarce. Paying particular attention to class, gender, and race, his account of how these libertos joined the labor market profoundly revises our understanding of the emancipation process and the evolution of the working class in Puerto Rico.
