Available in PDF, EPUB and Kindle. Book excerpt: Excerpt from The Ohio Manual of Legislative Practice: Published by the Authority of the Seventy-Fourth General Assembly, 1900-1901 Joint Committee on Rules to both houses; and by the further provision for a thorough revision of the contents of the book. In the present edition, it has been thought proper to change the arrangement, appearance and contents of the Manual, and to consolidate and codify the former separate rules of the two houses, and the joint rules, into a proper digest, which has been adopted as the rules of legislative practice. This is done, that the book may the more nearly meet the changing requirements of modern legislative proceedings which tend toward compact and accurate results, rather than toward the more elaborate methods of former adherence to purely parliamentary practice, and which demands effectiveness, rather than the older and more tedious usages. Excerpt: ...professedly to regulate its exercise or prevent its abuse, must be reasonable, uniform and partial. Monroe v. Collins, 17 Ohio St., 655. And see State v. Constantine, 42 Ohio St., 437. 3. The act of April 13, 1863 (60 v. 80), "to enable qualified voters of this State, in the military service of this State or of the United States, to exercise the right of suffrage," was intended to enable qualified voters of the State, in the military service, to vote in accordance with its provisions, as well without as within the territorial limits of this State. The act is not clearly in conflict with any constitutional provision, and is, therefore, to be regarded as a constitutional and valid enactment. It does not purport to have such extra' territorial operation and effect as would place its enactments beyond the legitimate sphere of the legislative power of the State, and so render them invalid. Lehman v. McBride, 15 Ohio St., 573. "The general principle which pervades the Constitution on the subject of elections, is that no one shall be allowed to participate in the, election of oflicers whose jurisdiction will not extend over him, or territorially include the place of his residence; but that the electors of each district or civil subdivision of the State shall have the right to elect their own oflicial representatives or public functionaries. Under a proper construction of the Constitution, persons having the qualifications of electors may justly claim a right to vote at all elections, of officers of the State, and of such other civil oflicers as by the provision of the Constitution and laws, are to be chosen by the electors of the county, township, ward or district in which such persons respectively reside.
