Book excerpt: Until now, there has no book that sets out structures and strategies for sound supply contract management. This book sets out to do more than this: it aligns the science of sourcing and procuring of supplies/suppliers with the art of smart contract management. And it does so based on the author's sound knowledge of global markets and keen understanding of commercial deal-making, flanked with the legal pillars that maintain governance in an otherwise chaotic state of variation. What is also special about this book is that it recognises the challenges of mixing the science of procurement with the art of contract management and works out ways to blend the cultural divide. The book is set out in a structured way to allow managers of business areas or their own businesses to manage contracts from a holistic standpoint, understanding and planning the reasons for seeking a contract before the suppliers are selected and before negotiations take shape. Supply contract management is explained as a 4 stage process from plan - to - procure - to - manage - to - review so that all the layers of contract management can be peeled away to shape the best fit supply chain. This book shapes best practice on a global scale, and in a very real and pragmatic way, using examples and case studies for illustration. By doing so, it is both a guide, a business coach and a form of handbook for any manager - or indeed supplier - working in any part of the supply chain.

Book excerpt: ‘Making It’ as a Contract Researcher examines the contemporary experience of research employment in universities from the perspective of a significant yet often invisible group: temporary or contract researchers, who make up a substantial, and ever-growing, proportion of the academic research workforce. A critical, pragmatic and international account of the contemporary research career, this book explores the question of what it means to ‘make it’ as a contract researcher in academia, and how individuals and organisations in higher education might seek to do things differently. Providing the reader with practical and realistic strategies for improving the experience of being a contract researcher and achieving and sustaining an academic research career, this book guides the reader on a range of topics, including: Charging fairly for your work Building a publication track record Finding the next contract Sustaining your network Feeling like you belong Moving beyond contract research. Using a combination of current research, interviews and reflective writing, the book is written specifically for and by contract researchers in academia, offering unique and extremely valuable advice for all new and current contract researchers, including PhD students, early career researchers, and any party interested in pursuing a research career in academia. The ‘Insider Guides to Success in Academia’ offers support and practical advice to doctoral students and early-career researchers. Covering the topics that really matter, but which often get overlooked, this indispensable series provides practical and realistic guidance to address many of the needs and challenges of trying to operate, and remain, in academia. These neat pocket guides fill specific and significant gaps in current literature. Each book offers insider perspectives on the often implicit rules of the game – the things you need to know but usually aren’t told by institutional postgraduate support, researcher development units, or supervisors – and will address a practical topic that is key to career progression. They are essential reading for doctoral students, early-career researchers, supervisors, mentors, or anyone looking to launch or maintain their career in academia.

  • Author : Gabrielle Elisabeth Golding
  • Publisher : Oxford University Press

Download or read book Shaping Contracts for Work written by Gabrielle Elisabeth Golding and published by Oxford University Press. This book was released on 2023-12-15 with total page 257 pages. Available in PDF, EPUB and Kindle. Book excerpt: Shaping Contracts for Work provides an in-depth examination of the common law's role in shaping employment contracts through the mechanism of implied terms. It constructs a theory which views the nature of the employment contract as distinct from other types of work contract. Terms implied by law into employment contracts, as well as their potential to operate in other non-standard contracts for the performance of work, are critically examined by reference to the test that courts adopt when they are asked to imply such terms. In part one, Golding provides an overarching survey of the law which governs express and implied terms in contracts. In doing so, she considers the broader judicial role in implying terms and assesses how it can fundamentally alter the nature of the relationship between contracting parties. Part two draws comparisons between England and Australia, tracing the origins and status of select terms across both jurisdictions, and exploring how the application of these terms is often presumed. Golding also examines the duties of mutual trust, confidence, and good faith in both jurisdictions, investigating their potential application in employment contracts. In part three, Golding demonstrates why courts need to better articulate their understanding of what constitutes an 'employment contract' as a distinctive class of contract. By focussing on the impact of terms implied by law, this work adds a unique dimension to the debate concerning the regulation of waged work in the context of ever-increasing non-standard modes of work.

Book Business Contracts Handbook

Download or read book Business Contracts Handbook written by Charles Boundy and published by CRC Press. This book was released on 2016-04-08 with total page 441 pages. Available in PDF, EPUB and Kindle. Book excerpt: If money is the lifeblood of business, contracts are the arteries that help carry it around the commercial body. Anyone in business is liable to have to deal with business contracts, but few are trained to do so. Even those that are trained may have experience in limited areas or in the distant past. But the right contract can make a vital difference, not just to recording and enforcing, if need be, the contract terms, but also in ensuring the agreement deals with the real issues and approaches them in a practical way. Finding help in this area is not easy, as the market tends to offer little between serious academic tomes on the one hand and student summaries geared to exams on the other. Business Contracts Handbook fills that gap, covering both the basics of contract law in an accessible style and using a thoroughly practical approach to understanding and negotiating the key terms in a business contract. If you have little prior knowledge, Charles Boundy's many years of experience in drafting and providing guidance on business agreements of all kinds will enable you to acquire a working background quickly. If you have years of experience you will still benefit from a checklist, a reminder of what is important and why, and an easy reference to up-to-date language and drafting - there is always more to learn.
