Book excerpt: The nearly two dozen studies in this collection explore the very rich ways in which the rule of law and the practice of magic enrich and inform each other. The authors bring both a U.S. and a comparative law perspective while examining areas such as law and religion, criminal law, intellectual property law, the law of evidence, and animal rights. Topics include alchemy in fifteenth-century England, a discussion of how a courtroom is like a magic show, stage hypnotism and the law, Scottish witchcraft trials in the eighteenth century, the question of whether stage magicians can look to intellectual property to protect their rights, tarot card readings and the First Amendment, and an analysis of whether a magician can be qualified as an expert witness under the Federal Rules of Evidence. "[E]rudite discussions of historical aspects all presented in a readable style. This text is greatly recommended." -- Joel Moskowitz, M.D., MagiCurrents "This fascinating collection explores the unexpected intersections and overlaps of the worlds of law and magic. From the rights of fortune tellers to the wrongs of pulling rabiits out of hats, from the use of magic in courtrooms to the use of intellectual property laws to protect magic secrets, from the illusion of burning your assistant alive to the reality of burning magicians as witches, these essays run the gamut. Eminently readable, thought-provoking, and highly informative, these essays should appeal to magicians, lawyers, or any other practitioner of the art of deception." -- Simon Aronson, Author of Try the Impossible and six other books presenting Aronson's original card magic creations; retired partner, Lord Bissell & Brook "This book contextualizes concepts from intellectual property and copyright law to animal rights and labor laws using the world of magic as backdrop. Discussions of the historical relationship between magic and law show how magic helped shape law's treatment of religion, science, and freedom of information. The chapters on modern law and magic serve as a handbook for magicians and entertainers as well as providing a unique way for students of law to study the concepts of the stage of magic entertainment." -- David Hira, David Hira Productions, Co-Producer of "Shows In A Box" "[F]or those whose lives sit squarely in both legal and conjuring circles, Law and Magic will be worth a look." -- Gabe Fajuri, MAGIC Magazine "[T]he 24 essays in this book are wonderful and full of wonder. They should be required reading..." -- GENII Magazine"[A] fascinating array of commentary that could be related to many shades or avenues of the concept of magic... I do hope Law and Magic will be read by many." -- The Amazing Kreskin "This is an important collection of essays that provides a definitive scholarly source on research into the various interconnections between law and magic. Written with wit and humour, the essays are a fascinating read for legal and non-legal scholars alike." -- The Law and Politics Book Review

Book excerpt: Set in an alternate reality where Richard the Lionheart’s descendants rule the Anglo-French Empire, the laws of magic have developed in place of the laws of physics. In this late 20th century world, people still travel through pea fog by horse and carriage, but magic has made levitation and enchantment spells the norm, especially at a sorcerer’s convention. The International Sorcerer’s Convention is in full swing. Until London’s Chief Forensics Sorcerer, Sir James Zwinge, is found dead inside a locked room, that is. Master Sean O Lochlainn had been at odds with Sir James over competing breakthroughs in incision-free surgery, making him the prime suspect. It’s up to Lord Darcy to solve Sir James’ murder and exonerate his own forensic sorcerer and trusted assistant. But the mystery deepens when the murder of a Naval spy is connected to that of Sir James’ death. Conflict with Poland, a dominating world power, changes the game and suddenly there is a lot more at stake than the freedom of Lord Darcy’s old friend. Too Many Magicians was nominated for the Hugo Award in 1967, and the complete Lord Darcy series later won the Sideways Award for Alternate History.

Download or read book Non Conventional Copyright written by Enrico Bonadio and published by Edward Elgar Publishing. This book was released on 2018-10-26 with total page pages. Available in PDF, EPUB and Kindle. Book excerpt: Copyright law constantly evolves to keep up with societal changes and technological advances. Contemporary forms of creativity can threaten the comfortable conceptions of copyright law as creative people continually find new ways of expressing themselves. In this context, Non-Conventional Copyright identifies possible new spaces for copyright protection. With current copyright law in mind, the contributions explore if the law should be more flexible as to whether new or unconventional forms of expression - including graffiti, tattoos, land art, conceptual art and bio art, engineered DNA, sport movements, jokes, magic tricks, DJ sets, 3D printing, works generated by artificial intelligence, perfume making, typefaces, or illegal and immoral works - deserve protection. Vitally, the contributors suggest that it may be time to challenge some of the basic tenets of copyright laws by embracing more flexible ways to identify protectable works and interpret the current requirements for protection. Additionally, some contributors cast doubts about whether copyright is the right instrument to address and regulate these forms of expression. Contemporary in topic, this thought-provoking book will be essential reading for intellectual property law scholars, practitioners and policymakers. Creative people and those involved in the creative industries will also find this book an engaging read.

In the book, this California-based national secret magical and religious group is called the "Church of Hu", though it has become nationally known as the Temple of Set. Members of the group, mostly from the well-educated middle class, consider themselves an elect and seek to develop themselves magically to achieve power. The Magicians looks at the group's beliefs, attitudes, and values, and shows how its focus on power and magic affects the members in everyday life. The book also discusses the dynamics involved in the search for power and considers the danger to society of groups using black magic to achieve power.

Book Secrets Revealed

Download or read book Secrets Revealed written by and published by . This book was released on 2007 with total page 37 pages. Available in PDF, EPUB and Kindle. Book excerpt: Intellectual property scholars have begun to explore the curious dynamics of IP's negative spaces, areas in which IP law offers scant protection for innovators, but where innovation nevertheless seems to thrive. Such negative spaces pose a puzzle for the traditional theory of IP, which holds that IP law is necessary to create incentives for innovation. This paper presents a study of one such negative space which has so far garnered some curiosity but little sustained attention -- the world of performing magicians. This paper argues that idiosyncratic dynamics among magicians make traditional copyright, patent, and trade secret law ill-suited to protecting magician's most valuable intellectual property. Yet, the paper further argues that the magic community has developed its own set of unique IP norms which effectively operate in law's absence. The paper details the structure of these informal norms that protect the creation, dissemination, and performance of magic tricks. The paper also discusses broader implications for IP theory, suggesting that a norm-based approach may offer a promising explanation for the puzzling persistence of some of IP's negative spaces.
