Book excerpt: La sentencia civil es una de esas instituciones ante la cual, tanto el académico como el profesional del derecho, nunca han podido quedarse indiferente. Esta resolución judicial pone fin al proceso civil y de alguna manera compendia todos los esfuerzos que el resto de instituciones procesales llevan a cabo a lo largo del proceso judicial. La sentencia y lo que esta supone cierra el arco del proceso judicial y no es posible entender la una sin el otro y viceversa. En el presente trabajo hemos querido seleccionar como objeto del mismo los requisitos internos de la sentencia civil. Más allá por tanto de las cuestiones de forma, el estudio que aquí se presenta analiza las características esenciales que debe tener la sentencia civil para satisfacer cumplidamente las finalidades a las que está llamada. Antes de afrontar los requisitos internos hemos querido desarrollar en el presente trabajo una primera parte en la que se analizan cuestiones insoslayables sobre la sentencia. Qué es y cómo se dicta una sentencia, modalidades de sentencias contempladas en la ley, el proceso de formación interna de la sentencia o las íntimas relaciones entre el derecho y la resolución judicial que pone fin al proceso son algunos de los estudios de aproximación al objeto del presente trabajo. Pero el grueso del mismo se centra en los requisitos internos recogidos en el artículo 218 LEC. La claridad y la precisión y el ámbito de estas. La exhaustividad, la congruencia, las exigencias de ambas, las formas de desatender estos requisitos y los mecanismos de subsanación. La motivación de la sentencia, que es la encarnación de la lógica y el razonamiento jurídico de la sentencia y que da respuesta a tantas garantías que se esperan de una sentencia cabal. Todos estos requisitos se afrontan desde un doble punto de vista. Por un lado, analizando las razones que la doctrina científica ha ido aportando para sustentar y definir los contornos de este régimen legal. Y, por otro lado, teniendo en cuenta un extenso estudio jurisprudencial del que se deduce la interpretación y las concreciones que los tribunales han hecho para dar respuesta a la pregunta de cómo debe ser la sentencia civil. Pedro Álvarez Sánchez de Movellán es Profesor Titular de Derecho procesal y Doctor por la Universidad de León con Premio Extraordinario. Cuenta con una amplia producción científica, con numerosos artículos y capítulos de libros, además de siete monografías, las más recientes sobre el incidente de nulidad de actuaciones y el proceso de impugnación de acuerdos sociales. Ha participado en diversos Proyectos de investigación, también como IP. Ha dirigido varias tesis doctorales y otros trabajos de investigación publicados. Es coordinador del Grupo de innovación docente del área de Derecho procesal, que cuenta con más de una docena de proyectos financiados, algunos de ellos en colaboración con el Centro de Estudios Jurídicos del Ministerio de Justicia. Como Magistrado suplente cuenta con una experiencia práctica en la aplicación del Derecho procesal. Es socio fundador de la Asociación para el Fomento del Arbitraje de Castilla y León.

Book excerpt: Despite legal and social advances in the past two decades, sexual and gender minorities continue to face widespread discrimination and violence in many countries. This discrimination and violence lead to exclusion, which adversely impacts their lives, as well as the communities and economies in which they live. A major barrier to addressing this stigma and sexual orientation and gender identity(SOGI)-based exclusion is the lack of SOGI-specific data. Robust, quantitative data on di‚fferential development experiences and outcomes of sexual and gender minorities--especially those in developing countries--is extremely thin. This paucity of data jeopardizes the achievement of the Sustainable Development Goals and countries' commitment to the principle of 'leaving no one behind' in the eff‚ort to end poverty and inequality. 'Equality of Opportunity for Sexual and Gender Minorities' assesses the unique challenges that sexual and gender minorities face in six important areas: (i) Criminalization and SOGI (ii) Access to education (iii) Access to the labor market (iv) Access to public services and social protection (v) Civil and political inclusion (vi) Protection from hate crimes. This report cov‚ers numerous policy recommendations to prevent and eliminate discriminatory practices in all of the areas covered. It also seeks to inflŽuence legislative changes and support research on institutions and regulations that can ultimately lead to poverty reduction and shared prosperity. At the same time, it acknowledges that the mere existence of inclusive laws and regulations does not ensure that sexual and gender minorities are free from discrimination--the enforcement of those laws is crucial. This publication, the first in a series of studies, will be expanded from the 16 countries included here to a wider set of countries for more in-depth quantitative analysis and to identify possible correlations with socioeconomic outcomes. It will seek to deepen knowledge, facilitate peer learning of good practices, and encourage reforms to increase the inclusion of sexual and gender minorities.
