Book excerpt: The draft Enhanced Terrorism Prevention and Investigation Measures Bill is intended to be introduced by the Government in response to "exceptional circumstances" which "cannot be managed by any other means". It is complementary to, and if introduced will operate alongside, the existing TPIMs legislation (as set out in the Terrorism Prevention and Investigation Measures Act 2011). If approved by Parliament, this Bill will allow the Government to impose a series of restrictive measures, broadly similar to those available under the control order regime, on certain targeted individuals. The Committee accepted the need for such measures as a preventative tool against suspected terrorists but raised concerns about the role of Parliament in approving their introduction and the threat to security created by "time-limiting" the legislation. To safeguard and better monitor their use, the Committee further called on the Government to institute higher standards of legal review of any use of this legislation.

Book excerpt: This book opens up the discussion of the interrelation between terrorism studies, and peace and conflict studies. The aim is to examine the instances and circumstances under which both fields can benefit from each other. Even though it is often accepted that terrorism is a form of political violence, it is also quite frequent that research on the topic is dismissed when it is approached with conflict analysis frames. More importantly, policy approaches continue to inhibit, obstruct and reject frameworks that are concerned with the transformation and resolution of terrorist conflicts – partly because they see the state as the ultimate referent object to be secured. At the same time, peace and conflict studies seem to be excessively focused on problem-solving approaches, which overemphasise the role of parity during negotiations and misdiagnose the distribution of power both within conflicts as well as within conflict management, resolution and/or transformation approaches. This book was published as a special issue of Critical Studies on Terrorism.

Book excerpt: Control orders were preventative measures, intended to protect members of the public from the risk of terrorism by imposing restraints on those suspected of involvement in terrorism-related activity. They have now been replaced with Terrorism Prevention and Investigation Measures (TPIMs). Control orders were made against 52 people over the lifetime of the Prevention of Terrorism Act 2005. All were men, suspected of involvement in Islamist terrorism. The duration of the orders was between a few months to more than four-and-a-half years. At the start of the control order regime in 2005, all controlled persons were foreign nationals. By the end of 2011, all were British citizens. The publication is divided into seven chapters with ten annexes: Chapter 1: Introduction; Chapter 2: Control orders in context; Chapter 3: How the system worked; Chapter 4: Use of control orders in 2011; Chapter 5: Terrorism prevention and investigation measures; Chapter 6: Conclusions; Chapter 7: Recommendation.

The increased security and intelligence activity of recent years has led to greater scrutiny including in the civil courts, which have heard a growing numbers of cases challenging Government decisions and actions in the national security sphere. Such cases involve information that under current rules cannot be disclosed in a courtroom. The UK justice system is then either unable to pass judgment and cases collapse or are settled without a judge reaching any conclusions. This green paper aims to respond to the challenges of how sensitive information is treated in the full range of civil proceedings. It looks for solutions that improve the current arrangements while upholding the Government's commitment to the rule of law. It also addresses the need for public reassurance that the national security work is robustly scrutinised, and that the scrutinising bodies are credible and effective. The proposals in this consultation are in three broad areas: enhancing procedural fairness, safeguarding material and reform of intelligence oversight.

A successful response to these threats depends on entrusting public bodies with the powers they need to identify and follow suspects in a borderless online world. But trust requires verification. Each intrusive power must be shown to be necessary, clearly spelled out in law, limited in accordance with international human rights standards and subject to demanding and visible safeguards. The current law is fragmented, obscure, under constant challenge and variable in the protections that it affords the innocent. It is time for a clean slate. This Report aims to help Parliament achieve a world-class framework for the regulation of these strong and vital powers.

Book excerpt: The review considered six key counter-terrorism and security powers: (1) the detention of terrorist suspects before charge; (2) section 44 stop and search powers and the use of terrorism legislation in relation to photography; (3) the use of the Regulation of Investigatory Powers Act 2000 (RIPA) by local authorities and access to communications data more generally; (4) measures to deal with organisations that promote hatred or violence; (5) extending the use of 'Deportation with Assurances' in a manner that is consistent with our legal and human rights obligations; (6) control orders (including alternatives). The review concludes that some counter-terrorism and security powers are neither proportionate nor necessary. The key findings are: (i) a return to 14 days as the standard maximum pre-charge detention period; (ii) an end to the indiscriminate use of stop and search powers under section 44; (iii) the end to the use of the most intrusive RIPA powers by local authorities to investigate low level offences and applications by authorities to use RIPA techniques need a magistrate's approval; (iv) a commitment to rationalise the legal bases by which communications data can be acquired; (v) a stronger effort to deport foreign nationals involved in terrorist activities in this country fully respecting our human rights obligations; (vi) the end of control orders and their replacement with a fairer and more focused regime. Additional resources will be provided to the police and security agencies to ensure the new measures are effective not only in protecting the public but in facilitating prosecution.

The independent reviewer in particular presents a fuller picture of the terrorist threat to the United Kingdom and its nationals, drawing particularly on the period 2010-2012; reviews the operation of all aspects of the Acts during 2012; requests views on possible changes to the definition of terrorism, with a view to making future recommendations; records progress made in relation to previous recommendations (e.g. in relation to proscription); and identifies other important issues (e.g. in relation to Schedule 7, currently subject to parliamentary as well as judicial attention). The Independent Reviewer considers the results of a programme of cautious and selective liberalisation of UK laws for dealing with terrorism are to be positive ones but that the threat from terrorism remains a substantial one. Amongst recommendations made were those relating to the rules relating to proscription (and in particular deproscription), some aspects of schedule 8 detention and the operation of schedule 7 power to stop and examine those travelling through ports

Book excerpt: Lord Macdonald was asked by the Home Secretary to provide independent oversight of the review of security and counter-terrorism powers. The purpose of the review - carried out by the Office for Security and Counter Terrorism (OSCT) in the Home Office - was to determine whether it might be possible to roll some back some of the measures imposed by counter-terrorism and other legislation over the last decades whilst still providing protection for the UK's citizens. Lord Macdonald outlines the process of the review, noting that the OSCT surveyed a wide range of evidence, engaged with many interested parties and maintained a high degree of impartiality. His report then discusses the process whereby the review reached its conclusions on: pre-charge detention; terrorism stop and search section 44); photography and the use of counter-terrorism powers; the Regulation of Investigatory Powers Act and local authorities; access to communications data; groups that espouse or incite violence or hatred; deportations of foreign nationals engaged in terrorism; control orders. Lord Macdonald believes that the recommended reduction in pre-charge detention to 14 days, the repeal of section 44, the greater regulation of local authority surveillance and the outright removal of those aspects of control orders that most resemble house arrest, are all to be regarded as reforms of real significance. They point to an unmistakable re-balancing of public policy in favour of liberty.
