Available in PDF, EPUB and Kindle. Book excerpt: In the first modern biography of Lord Mansfield (1705-1793), Norman Poser details the turbulent political life of eighteenth-century Britain's most powerful judge, serving as chief justice for an unprecedented thirty-two years. His legal decisions launched England on the path to abolishing slavery and the slave trade, modernized commercial law in ways that helped establish Britain as the world's leading industrial and trading nation, and his vigorous opposition to the American colonists stoked Revolutionary fires. Although his father and brother were Jacobite rebels loyal to the deposed King James II, Mansfield was able to rise through English society to become a member of its ruling aristocracy and a confidential advisor to two kings. Poser sets Mansfield's rulings in historical context while delving into Mansfield's circle, which included poets (Alexander Pope described him as "his country's pride"), artists, actors, clergymen, noblemen and women, and politicians. Still celebrated for his application of common sense and moral values to the formal and complicated English common law system, Mansfield brought a practical and humanistic approach to the law. His decisions continue to influence the legal systems of Canada, Britain, and the United States to an extent unmatched by any judge of the past. An illuminating account of one of the greatest legal minds, Lord Mansfield presents a vibrant look at Britain's Age of Reason through one of its central figures.

Book English Common Law in the Age of Mansfield

Download or read book English Common Law in the Age of Mansfield written by James Oldham and published by Univ of North Carolina Press. This book was released on 2005-12-15 with total page 445 pages. Available in PDF, EPUB and Kindle. Book excerpt: In the eighteenth century, the English common law courts laid the foundation that continues to support present-day Anglo-American law. Lord Mansfield, Chief Justice of the Court of King's Bench, 1756-1788, was the dominant judicial force behind these developments. In this abridgment of his two-volume book, The Mansfield Manuscripts and the Growth of English Law in the Eighteenth Century, James Oldham presents the fundamentals of the English common law during this period, with a detailed description of the operational features of the common law courts. This work includes revised and updated versions of the historical and analytical essays that introduced the case transcriptions in the original volumes, with each chapter focusing on a different aspect of the law. While considerable scholarship has been devoted to the eighteenth-century English criminal trial, little attention has been given to the civil side. This book helps to fill that gap, providing an understanding of the principal body of substantive law with which America's founding fathers would have been familiar. It is an invaluable reference for practicing lawyers, scholars, and students of Anglo-American legal history.

Book Great Christian Jurists in English History

Download or read book Great Christian Jurists in English History written by Mark Hill and published by Cambridge University Press. This book was released on 2017-06-09 with total page 621 pages. Available in PDF, EPUB and Kindle. Book excerpt: The Great Christian Jurists series comprises a library of national volumes of detailed biographies of leading jurists, judges and practitioners, assessing the impact of their Christian faith on the professional output of the individuals studied. Little has previously been written about the faith of the great judges who framed and developed the English common law over centuries, but this unique volume explores how their beliefs were reflected in their judicial functions. This comparative study, embracing ten centuries of English law, draws some remarkable conclusions as to how Christianity shaped the views of lawyers and judges. Adopting a long historical perspective, this volume also explores the lives of judges whose practice in or conception of law helped to shape the Church, its law or the articulation of its doctrine.

Book A State Built on Sand

Download or read book A State Built on Sand written by David Mansfield and published by Oxford University Press. This book was released on 2016-05-01 with total page 418 pages. Available in PDF, EPUB and Kindle. Book excerpt: Oscillations in opium poppy production in Afghanistan have long been associated with how the state was perceived, such as after the Taliban imposed a cultivation ban in 2000-1. The international community's subsequent attempts to regulate opium poppy became intimately linked with its own state-building project, and rising levels of cultivation were cited as evidence of failure by those international donors who spearheaded development in poppy-growing provinces like Helmand, Nangarhar and Kandahar. Mansfield's book examines why drug control - particularly opium bans - have been imposed in Afghanistan; he documents the actors involved; and he scrutinizes how prohibition served divergent and competing interests. Drawing on almost two decades of fieldwork in rural areas, he explains how these bans affected farming communities, and how prohibition endured in some areas while in others opium production bans undermined livelihoods and destabilized the political order, fuelling violence and rural rebellion. Above all this book challenges how we have come to understand political power in rural Afghanistan. Far from being the passive recipients of violence by state and non-state actors, Mansfield highlights the role that rural communities have played in shaping the political terrain, including establishing the conditions under which they could persist with opium production.

Book Mansfield s Book of Manly Men

Download or read book Mansfield s Book of Manly Men written by Stephen Mansfield and published by HarperChristian + ORM. This book was released on 2013-11-26 with total page 302 pages. Available in PDF, EPUB and Kindle. Book excerpt: Witty, compelling, and shrewd, Mansfield’s Book of Manly Men is about resurrecting your inborn, timeless, essential, masculine self. The Western world is in a crisis of discarded honor, dubious integrity, and faux manliness. It is time to recover what we have lost. Stephen Mansfield shows us the way. Working with timeless maxims and stirring examples of manhood from ages past, Mansfield issues a trumpet call of manliness fit for our times. In Mansfield’s Book of Manly Men, you’ll see that: This book is about doing. It is about action. It is about knowing the deeds that comprise manhood and doing those deeds. Habits have to be formed, and actions have to be aligned with the grace received. “My goal in this book is simple,” Mansfield says. “I want to identify what a genuine man does?the virtues, the habits, the disciplines, the duties, the actions of true manhood?and then call men to do it.”

Book excerpt: A literary venture into the economic shadow that slavery cast, Feeding the Ghosts, based on a true story, lays bare the raw business of the slave trade. The Zong, a slave ship packed with captive African “stock,” is headed to the New World. When illness threatens to disable all on board and cut potential profits, the ship’s captain orders his crew to throw the sick into the ocean. After being hurled overboard, Mintah, a young female slave taken from a Danish mission, is able to climb back onto the ship. From her hiding place, she rouses the remaining slaves to rebel and stirs unease among the crew with a voice and conscience they seem unable to silence. Mintah’s courage and others’ reactions to it unfold in a suspenseful story of the struggle to live even when threatened by oblivion.
