Book excerpt: Este trabajo se orienta fundamentalmente a consolidar, clarificar y estructurar el marco normativo por el que se regula el derecho a la protección de la salud, el cual, por su vinculación con los derechos fundamentales, y especialmente, por su conexión con el artículo 15 CE, puede considerarse un derecho fundamental. Asimismo, y vinculados con los derechos fundamentales, se reconocen los derechos del paciente, y especialmente la autonomía de la decisión. La Ley 14/1986, de 25 de abril, Ley General de Sanidad, la Ley 16/2003, de 28 de mayo, de cohesión y calidad del Sistema Nacional de Salud y la Ley 33/2011, de 4 de octubre, General de Salud Pública, constituyen el marco normativo estatal de desarrollo del derecho a la salud. En virtud del proceso de descentralización competencial, algunas Comunidades Autónomas han establecido su propia normativa en materia sanitaria. La actual coyuntura económica ha supuesto una modificación del marco regulador de la sanidad pública a través de la aprobación del Real Decreto-ley 16/2012, de 20 de abril, de medidas urgentes para garantizar la sostenibilidad del Sistema Nacional de Salud y mejorar la calidad y seguridad de sus prestaciones. A ello hay que unir el fenómeno de la privatización que ha ido incrementándose a lo largo de estos años en nuestro país.

The report comprehensively examines why there has been so little justice for atrocity crimes, and finds the main answers in political obstruction. Given the lack of political will to end impunity, new approaches must be taken.
