Book excerpt: Excerpt from Letters of Members of the Continental Congress, Vol. 1: August 29, 1774 to July 4, 1776 Some part of Duane's notes were long ago published in S. W. Jones's Memoir, but other parts have not, it is believed, before appeared in print. Of some of them, unfortunately, only imperfect copies have been found. Of other items of the sort that have been mentioned only small portions have heretofore been printed. There are few diaries Of delegates covering the periods of their service in Congress, and fewer still that are of first-rate importance. That Of John Adams is perhaps the best known and has long been accessible. With some breaks it extends over his entire period of service, from Sep tember, 1774, to November, 1777, but as a rule it touches the proceedings of Congress only incidentally. The diary of Richard Smith, extending from September, 1775, to March, 1776, was first made available in 1896, in volume I. Of the American Historical Review. It is essentially a diary of proceedings in Congress and contains much information not elsewhere to be found. Samuel Ward's diary, published in 1877, in volume I. Of the Magazine of American History, is more abbreviated in its entries and Often contains little or no information not found in the journals. It comes to an end November 2, 177 5. The diary of John Fell of New Jersey, which covers the period from November 29, I 778, to November 30, I 779, has not been published. It is comparable with that Of Richard Smith, although the entries are by no means so extensive. The diary Of Samuel Holten Of Massachusetts, extending from May, I 778, to August, 1780 (published in the Essex Institute Historical Collections, 1919 - 1920) makes only the briefest references to the proceedings of Congress; and that of William Samuel Johnson 1785-1786) is even less informing. Book excerpt: Excerpt from Letters of Members of the Continental Congress, Vol. 4: January 1 to December 31, 1779 During the period covered by this volume, the year 1779, Congress was occupied with a multitude of matters, some Of them for a large part Of its time during the whole or nearly the whole of the year, others occasionally and for briefer periods. Some of the problems that engrossed that body were Of vital importance; other questions - and the space which they occupy in the Journals is large in the total - were of a minor sort that might more properly have been relegated to committees or to one or another of the executive boards, but which Congress had not yet quite learned to separate from its own immediate control. In the survey of the activities of Congress which follows it has not been deemed needful to do more than to endeavor to bring into clearer view some of the more important subjects that came under consideration during the year and to give a measure Of sequence to the proceedings upon them. With the ratification by New Jersey Of the Articles Of Confederation at the end of November, 1778, there was hope that the consummation of the Confederation was close at hand. There had been little doubt of Delaware's accession, and agreeably to this expectation Congress was informed on February 8 that that state had authorized her delegates to subscribe to the Articles. But hopes Of Maryland's early accession had already all but vanished; for on January 6 the Maryland delegates laid before Congress a declaration Of the assembly of their state, adopted in the preceding December, refusing to join the Confederation unless the conditions stipulated should be complied with. Instructions to the delegates were adopted at the same time, but these instructions. Were not presented to Congress until the following May. There are numerous able examinations of the question based on all the essential facts. It may nevertheless be remarked that from such expressions as have come down to us from members Of Congress it is difficult to escape the conclusion that, while grounds were not wholly lacking for suspicion, the majority of Congress had attained that state of mind that welcomed an excuse for an act concerning the honorableness of which they had doubts but Of the expediency of which they were wholly convinced, and that Burgoyne's petulant phrase, the public faith is broke was eagerly seized upon as offering them the very handle they desired. The want hitherto Of a proper line to be drawn between Congress and the states Mathews Of South Carolina wrote at this time to Governor Livingston Of New Jersey, has been the cause of numberless embarrass ments, for whilst the states were left ad libitum, some would do a great deal, some a little, others scarcely anything yet he anticipated the most happy consequences from the ratification Of the Articles. On the Sixth Of March, on a motion Of Varnum Of Rhode Island, seconded bv Root Of Connecticut, a committee was appointed to prepare a plan to invest Con gress with full and explicit powers for effectually carrying into execution in the several states all acts or resolutions passed agreeably to the Articles Of Confederation and Var'num, Duane, and Madison, three men su premely interested in the Object aimed at, were appointed for the purpose. A report by the committee, principally drawn by Madison and bearing the date March 12, was Offered in Congress March 16, but was not taken into consideration until May 2. If approved by Congress and ac quiesced in by the states, Varnum wrote March 16, the willing States will be greatly relieved The committee reported that, whilst the 13th article Of the Confederation contained an implied power in Congress to enforce every provision Of the Confederation against any state which should refuse or neglect to abide by the determinations Of Congress, never theless all exercise Of power should be explicitly and precisely warranted It was therefore proposed that the articles be so amended as to authorize Congress to employ the land or sea forces of the United States to compel any delinquent state to fulfill its federal engagements. John Mathews at the same time Offered the milder proposition that the states be requested to pass laws vesting in Congress, in time Of war, such powers as might be necessary for efficiently prosecuting the war.
