Juridicisation et judiciarisation sont d'autres manières de désigner le même phénomène. Mais celui-ci est-il seulement quantitatif ? En réalité, depuis la fin de la Seconde Guerre mondiale, le droit est le lieu de transformations profondes, complexes, voire antagonistes : rôle accru de l'éthique après les horreurs du nazisme, émergence de la bioéthique, déclin du pouvoir législatif, affaiblissement de la légitimité de la loi, juridicisation du politique, développement fulgurant du contrôle juridictionnel de constitutionnalité, émiettement de l'autorité de l'État, influence de l'économie sur le droit par le biais de l'analyse économique du droit... La mutation est hétérogène. Pluralisme, recherche de la négociation, juridicisation des normes techniques, promotion de l'idée de régulation : ainsi se dessine un puissant mouvement de contractualisation du droit lié à la mondialisation, certains évoquant même une paradoxale reféodalisation du lien social. N'est-il pas, en conséquence, opportun de créer de nouvelles catégories juridiques ? II existe trois moments fondateurs de l'ordre juridique. D'abord, les droits de l'homme ou droits humains : leur évolution actuelle n'en dénature-t-elle pas le projet ? Ensuite, la juridicisation du politique illustrée par la constitutionnalisation du droit ne conduit-elle pas - risque ou chance - au gouvernement des juges ? Enfin, quelle est la signification de la procéduralisation concernant l'évolution du droit ? En quoi et à quelles conditions le droit doit-il s'y conformer ?

Nos sociétés démocratiques seraient-elles ainsi en train de dériver vers une sorte d'impérialisme juridique? Telles sont quelques-une des interrogations qui ont présidé à la préparation de cet ouvrage qui invite à un vaste questionnement.
