Book excerpt: This volume consists of a carefully edited version of the General Course on Public International Law delivered at the Hague Academy of International Law to commemorate the fiftieth anniversary of the foundation of the United Nations. The author brings to them not only his background of academic distinction, but his experience as a practitioner concerned with major international legal issues. The rule of law in international affairs is a question of perennial concern but it is of greater moment these days for a number of reasons. The active agenda of the Security Council and its relative solidarity creates a paradox. Its increased political power is a source of hope but the modalities of the exercise of power present problems of principle and of legal concern. Another area of concern is the International Court, which has had a successful record since the early eighties and provides one of the guarantees of the maintenance of legality. Recent successes of the Court include the effective resolution of the territorial dispute between Chad and Libya. The general level of compliance with its decisions by States is impressive. Yet its success is matched not by encouragement and enhancement of its facilities but by United Nations financial constraints which hinder its work and, ultimately, may threaten its independence in relation to the political organs of the United Nations.

As he told me on more than one occasion, he had every intention of bringing out another edition. In Marc Bloch's own mind this was not simply a matter of reissuing the original text. He knew, none better, that time stops for no historian, that every good piece of historical writing needs to be rewritten after twenty years: otherwise the writer has failed in his objective, failed to goad others into testing his foundations and improving on his rasher hypotheses by subjecting them to greater precision. Marc Bloch was not given time to refashion his great book as he would have wished. One wonders whether he would in fact ever have brought himself to do it. I have the impression that the prospect of this somewhat dreary and certainly difficult task (however one may try to avoid it, revision of an earlier work is always hampered by the original design, which offers few easy loopholes for escape) held less appeal than the excitement of conceiving and executing an entirely new book. However this may be, our friend has carried this secret, with so many others, to his grave. The fact remains that one of our historical classics, now more than twenty years old, is due for republication and is here presented to the reader.

Though the genocide of 1994 catapulted Rwanda onto the international stage, English-language historical accounts of the Great Lakes region of Eastern Africa--which encompasses Burundi, eastern Congo, Rwanda, western Tanzania, and Uganda--are scarce. Drawing on colonial archives, oral tradition, archeological discoveries, anthropologic and linguistic studies, and his thirty years of scholarship, Jean-Pierre Chr tien offers a major synthesis of the history of the region, one still plagued by extremely violent wars. This translation brings the work of a leading French historian to an English-speaking audience for the first time. Chr tien retraces the human settlement and the formation of kingdoms around the sources of the Nile, which were "discovered" by European explorers around 1860. He describes these kingdoms' complex social and political organization and analyzes how German, British, and Belgian colonizers not only transformed and exploited the existing power structures, but also projected their own racial categories onto them. Finally, he shows how the independent states of the postcolonial era, in particular Burundi, Rwanda, and Uganda, have been trapped by their colonial and precolonial legacies, especially by the racial rewriting of the latter by the former. Today, argues Chr tien, the Great Lakes of Africa is a crucial region for historical research--not only because its history is fascinating but also because the tragedies of its present are very much a function of the political manipulations of its past.

Endorsing the adjustment of existing rules to meet pluralist objectives, the author outlines a single, coherent regulatory approach. He shows how a careful analysis of the implications of technological convergence helps to solve conflicts between regimes. Specifically, the analysis addresses the level – national or EU – at which particular regulatory responses should emerge, the objectives guiding action, and the tools through which these objectives may be pursued. L'analyse de la jurisprudence de la Cour européenne des Droits de l'Homme invite à s'interroger sur le fait de savoir si la catégorie des " principes généraux du droit " existe également dans le système de la Convention européenne des Droits de l'Homme. En présence d'un texte formulé de manière très générale, voire lapidaire et nécessitant une actualisation constante, contenant nécessairement des lacunes, le recours aux " principes généraux du droit " pourrait sembler évident. Cependant, la jurisprudence de la Cour de Strasbourg ne permet pas de conclure à l'existence de " principes généraux du droit " au sein de sa jurisprudence. En revanche, elle permet de mettre en exergue l'existence d'une autre catégorie, celle des " principes généraux ". Les caractéristiques propres et les spécificités de cette technique au sein de la Convention européenne des Droits de l'Homme peuvent être mis en évidence suite à sa comparaison avec celle des " principes généraux du droit " connue dans les jurisprudences des juges internes, du juge international ou du juge communautaire et suite à la comparaison des différents ordres juridiques avec le système européen de protection des Droits de l'Homme.
