Book excerpt: A l'ère de la mondialisation, le modèle libéral et démocratique de politique criminelle que nous connaissions jusqu'à présent en Europe se trouve en équilibre fragile, car il subit de nombreuses perturbations provenant le plus souvent de sources extraétatiques. La politique criminelle balance entre politique sécuritaire et libérale ; et en même temps, sous l'influence du marché global, entre zones de droit et de non-droit (pénal). Face aux nouveaux dangers, on constate un double standard. D'une part, répression et d'autre part, non seulement absence de répression, mais qui plus est, non-intervention du système pénal, quand le criminel se trouve être une société transnationale. Quelles sont les relations entre mondialisation, politique criminelle, Etat et Démocratie ? Dans une crise économique provoquée par le néolibéralisme, qui désormais détermine tous les choix et les réponses du Droit, il semble que tous ont succombé aux règles de la mondialisation. En outre, cette dernière, secondée par les nouvelles technologies, pousse la politique criminelle vers un modèle totalitaire sous la gouvernante globale. Le vrai danger n'est pas seulement que le modèle libéral de politique criminelle se perde, mais que tout l'édifice du Droit avec l'idée même de Justice ne s'écroule avec lui. La problématique de l'auteur tourne autour du nouveau visage de la politique criminelle à l'ère de la mondialisation, qui est lié aux questions suivantes : - Quelles sont les tendances actuelles de politique criminelle ? - Quelles influences subit-elle et quelles en sont les conséquences ? - Quelle est la relation entre la sécurité des personnes et celle des marchés ? - Quel est le rôle des nouvelles technologies dans l'élaboration des choix de politique criminelle ? - Y a-t-il à des moyens de remédier au glissement du modèle libéral de politique criminelle, ou est-ce un glissement irréversible vers un modèle totalitaire ?
