Le courtage aux enchères a ainsi généré un essor du commerce de produits contrefaits. L’encadrement juridique du commerce par voie électronique a certes évolué depuis l’apparition de ce mode de commercialisation, et les juristes, tant praticiens que théoriciens, tentent d’adapter le droit aux incessantes évolutions techniques. Cependant, en l’état, le droit positif demeure lacunaire.
