Book excerpt: Employée de l'Office social de l'asile depuis août 2007, mon travail consiste en l'octroi de l'aide sociale pour un certain nombre de requérants d'asile (90 dossiers). Avec l'accord de l'Office, j'ai pu utiliser quelques exemples issus de ma pratique professionnelle pour examiner le quotidien des enfants requérants d'asile à la lumière de la Convention des droits de l'enfant CDE. D'autre part, l'ancien chef de notre Office (qui a quitté ses fonctions au 1er janvier 2008) a proposé que les conclusions de ce travail orientent la politique d'aide sociale du Service des Migrations du Canton de Neuchâtel. Vu ma profession, j'ai surtout examiné dans ce travail quelles propositions pouvaient être faites dans le domaine de l'aide sociale pour enfants des requérants d'asile pour tendre à une meilleure application de la CDE. Je ne me suis pas penchée sur le sort des mineurs non accompagnés MNA qui sont sous la tutelle d'un assistant social de l'Office des Mineurs du Canton. Je ne me suis pas non plus attelée à examiner le sort des enfants sans papiers. Ce travail de diplôme commence par une présentation des principes clés de la Convention de 1989, suivi d'une étude article des dispositions de la Convention liées à notre sujet. Les nouvelles lois votées par le peuple suisse en 2006 ont entraîné un durcissement de la politique d'asile en Suisse. Les enfants sont particulièrement touchés et subissent les conséquences de ce durcissement. Il est incroyable qu'aucune attention ne soit portée aux droits de l'enfant requérants d'asile dans un pays comme la Suisse dix ans après l'entrée en vigueur de la Convention des Droits de l'enfant ! Dans ma pratique professionnelle, j'apprends à travailler avec des règles contredites par de nombreuses exceptions. Il en résulte un flou juridique qui peut être favorable aux requérants d'asile que l'on représente car en demandant des règles claires par souci d'équité, la hiérarchie en profite pour soudainement niveler les règles par le bas. En conclusion de ce travail, j'ai énuméré diverses propositions claires afin de tendre à une meilleure application de la Convention des droits de l'enfant aux requérants d'asile mineurs. Le fait que les enfants requérants d'asile à l'assistance sociale touchent près de la moitié du minimum vital accordé aux autres enfants bénéficiaires de l'aide sociale est un fait gravement discriminatoire et une violation des articles 2 et 26 CDE. Les suppléments habituellement versés aux familles à l'aide sociale sont inexistants pour les requérants d'asile. Les différences de calcul des budgets d'un apprenant à l'aide sociale usuelle est d'un apprenant requérant d'asile constituent des discriminations interdites par le CDE. Aucun montant n'est alloué pour des activités sportives ou culturelles aux enfants requérants d'asile. Et j'en passe. Certes, le canton de Neuchâtel utilise des mesures de sécurité sociale en guise de pression pour que les requérants d'asile n'affluent pas dans notre Etat. Toutefois, on ferme les yeux sur le fait que des enfants sont touchés. Cette cécité a des conséquences non négligeables, c'est au sentiment de justice sociale que le législateur et l'administration touchent. C''est l'idée même de solidarité qui est mise à mal. Or, la solidarité est une condition plus nécessaire que jamais pour maintenir un minimum de sentiments de sécurité sans lequel la cohésion sociale n'a plus aucune chance.
