Book The Methodology of Constitutional Theory

Download or read book The Methodology of Constitutional Theory written by Dimitrios Kyritsis and published by Bloomsbury Publishing. This book was released on 2022-02-24 with total page 486 pages. Available in PDF, EPUB and Kindle. Book excerpt: What sort of methods are best suited to understanding constitutional doctrines and practices? Should we look to lawyers and legal methods alone, or should we draw upon other disciplines such as history, sociology, political theory, and moral philosophy? Should we study constitutions in isolation or in a comparative context? To what extent must constitutional methods be sensitive to empirical data about the functioning of legal practice? Can ideal theory aid our understanding of real constitutions? This volume brings together constitutional experts from around the world to address these types of questions through topical events and challenges such as Brexit, administrative law reforms, and the increasing polarisations in law, politics, and constitutional scholarship. Importantly, it investigates the ways in which we can ensure that constitutional scholars do not talk past each other despite their persistent - and often fierce - disagreements. In so doing, it aims systematically to re-examine the methodology of constitutional theory.

Book The Governing Law of Companies in EU Law

Download or read book The Governing Law of Companies in EU Law written by Justin Borg-Barthet and published by Bloomsbury Publishing. This book was released on 2012-04-09 with total page 210 pages. Available in PDF, EPUB and Kindle. Book excerpt: The manner in which the governing law of companies is determined has attracted much attention from academics and practitioners alike ever since the European Court of Justice began receiving references for preliminary rulings regarding the compatibility of protective conflict of corporate law norms with the EC Treaty provisions concerning freedom of establishment. Although recent developments have been less controversial than the ground-breaking judgment in Centros, they have not only consolidated the general thrust of liberalisation occasioned by the Court of Justice, but have added new dimensions to the regulatory landscape. These developments include amendments to the European constitutional order enshrined in the Lisbon Treaty, European legislation on cross-border mergers, the proposed statute for a European Private Company, the judgment of the Court of Justice in Cartesio and a Commission communication that contemplates the introduction of legislation on the governing law of companies. This book examines these recent developments and appraises the current law, as well as the foreseeable trajectory of the law, within a theoretical setting that addresses the socio-economic and legal-theoretical concerns associated with choices of the governing law of companies. In addition to considering the present and probable future state of EU law, the book also develops new theoretical perspectives and proposes novel solutions to long-standing dilemmas. In particular, it suggests that the use of information technology may render possible previously impossible compromises between party autonomy and the proper locus of prescriptive sovereignty.

Book Adoption and Law

Download or read book Adoption and Law written by Lisamarie Deblasio and published by Routledge. This book was released on 2020-07-23 with total page 200 pages. Available in PDF, EPUB and Kindle. Book excerpt: Using a socio-legal framework, this book explores the experiences that birth mothers face in state sanctioned adoption proceedings in the UK. Featuring personal, in-depth interviews and conversations with 32 birth mothers, the book highlights perspectives and voices that are seldom the focus in leading discourses of professional practice in this area of law. The book also demands that the statutory rights, support and care of birth mothers are recognised and strengthened. This book delivers a comprehensive insight into many aspects and controversies of legal child adoption, including the development and reform of adoption law over history, giving the reader insight into the deep-rooted political and social tensions around the use of adoption. The uniqueness of birth mothers’ subjective stories of adoption contrasts powerfully with the legal theory providing the reader with an intimate paradigm of adoption. The book includes discussion of obiter dicta and authoritative guidance on adoption practice from the Supreme Court and Court of Appeal in Re B (A Child) (Care Proceedings: Appeal) [2013] UKSC 33 and Re B-S (Children) (Adoption: Leave to Oppose) [2013] EWCA Civ 1146. It also considers Court of Appeal’s recent ruling on post adoption contact in Re B (A Child) (Post-Adoption Contact) [2019] EWCA Civ 29, the first case to come before the court since section 9 of the Children and Families Act 2014 amended the Adoption and Children Act 2002, with the new insertion of section 51A and 51B providing for court ordered post adoption contact. This book is ideally suited to undergraduate students, as well as a more multi- disciplinary audience.

Book Regulation Making in the United Kingdom and Australia

Download or read book Regulation Making in the United Kingdom and Australia written by Andrew Edgar and published by Bloomsbury Publishing. This book was released on 2024-01-25 with total page 303 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book shines a spotlight on the way in which parliamentary scrutiny of regulations provides the primary support for democratic legitimacy for regulations in the UK and Australia. This democratic safeguard is supplemented by public consultation processes. Despite commonly expressed concerns that regulation-making is secretive and undemocratic, it can be recognised to be a democratically sound and important feature of modern law. There are, however, modern practices that remove or limit these safeguards on regulation-making, raising concerns about executive aggrandisement. This book has two aims. The first is to explain the systems of parliamentary scrutiny in the UK and Australia and their historical development. The development of parliamentary checks on regulation-making through the 20th century established the primary basis for the democratic legitimacy of regulations. The second aim is to examine recent developments in regulation-making that avoid or minimise this safeguard. Constitutional changes in the UK, transnational regulation, and emergencies such as the COVID-19 pandemic have affected regulation-making in a manner that avoids or minimises the parliamentary checks that were carefully developed and implemented in the 20th century. The book contributes to public law in the UK and Australia by analysing recent developments that involve executive over-reach, with reference to the historical development of parliamentary checks on regulation-making.
