Book excerpt: Legislating for the ecosystem approach to fisheries (EAF) is complex, due to the holistic nature of the EAF involving multiple factors that underpin the social, economic, environmental, and institutional aspects of fisheries sustainability. These factors include ecosystems integration, risks, intersectoral collaboration, research, participatory processes, monitoring, control, surveillance, and enforcement, among others. To assess how the EAF is being implemented through national policy and legal frameworks, FAO developed "A diagnostic tool for implementing an ecosystem approach to fisheries through national policy and legal frameworks". This second edition of the legal report on the EAF contains a revised analysis of the extent to which the 82 EAF legal requirements, which are considered the minimum standards in legislating for the EAF, are incorporated in the United Republic of Tanzania's policy and legal instruments relevant to the fisheries sector and other relevant sectors of the country (such as environment, wildlife, ecosystems, and maritime affairs). Based on this preliminary diagnosis, gaps were identified in the assessed instruments, and recommendations were made for improving the implementation of the EAF. This second edition of the EAF Legal Report of the United Republic of Tanzania is based on the findings from two missions carried out by FAO, with support from the EAF-Nansen Programme, to the United Republic of Tanzania. The first mission was undertaken in March 2023, when the first edition of the report was presented to the government and various other stakeholders, in Dodoma, and additional information was collected. Additional information was collected in the second mission, undertaken in August 2023, when FAO supported the Ministry of Livestock and Fisheries of the United Republic of Tanzania in launching the process for the comprehensive review of the 2015 National Fisheries Policy and the 2003 Fisheries Act, as amended in 2020, from Mainland Tanzania, at a national workshop held in Morogoro. The second edition of the EAF Legal Report of the United Republic of Tanzania was endorsed by the Ministry of Livestock and Fisheries in August 2023.

Book excerpt: The ecosystem approach to fisheries (EAF) is a risk-based management process for the planning, management, development, regulation and monitoring of fishing and fishing-related activities. EAF addresses ecological consequences of fishing as well as social, economic and institutional aspects of fisheries sustainability. Adequate legislation and regulatory frameworks are key to successful implementation of the EAF. The continuous review and update of information on legislation and regulatory instruments require the analysis of existing legal frameworks at all levels of governance, to assess whether they remain in force, valid and aligned with international fisheries law standards, including the EAF. The present work was prepared with a view to provide current information on how the EAF is being implemented through national legal frameworks of selected countries in Africa. It revisits a previous legal study prepared by Anniken Skonhoft and published by FAO in 2011. A decade later, based on the scope of that study, the present work provides updated data and contributes to the knowledge on the current global and regional legal frameworks for an EAF, which are vital for EAF implementation purposes. This update also re-analysed certain countries’ national legislation and their evolution with respect to capturing the EAF requirements. Ultimately, the present work supports the legal implementation of an EAF for a holistic, integrated and innovative way of managing fisheries that promotes the participation of all relevant stakeholders and the use of best available knowledge for decision making, whilst balancing the human dimensions with the care for the environment, habitats, ecosystems and biodiversity related with fishery resources on which they depend.

One of them is by reviewing national policy and legal instruments to identify gaps which prevent a country from progressing towards full alignment with, and implementation of, an EAF. This diagnostic tool builds on the previous work of FAO by translating the 17 EAF components identified in the How-to Guide on legislating for an EAF into an EAF Legal Checklist for legal practitioners, policymakers and fisheries managers to use in conducting a preliminary assessment of selected policy and legal instruments and determining whether they are congruent an EAF. The outcomes of the assessment may result in decisions to amend existing national policies and/or legislation, or develop new policy and legal instruments that are aligned with the 17 EAF components, to ensure the full implementation of an EAF towards improving, in a holistic way, the conservation and sustainable use of marine resources, biodiversity and ecosystems.

This publication describes the three major steps in spatial planning and management, namely, zoning, site selection and design of an aquaculture management area, or AMA. The rationale for and objectives of each step, the ways (methodologies) to implement it, and the means (tools) that are available to enable a methodology are described in a stepwise fashion. Recommendations to practitioner s and policy-makers are provided. A separate policy brief accompanies this paper. The benefits from spatial planning and management are numerous and include higher productivity and returns for investors, and more effective mitigation of environmental, economic and social risks, the details of which are provided in this paper. This publication is organized in two parts. Part one is the “Guidance”; it is the main body of the document and describes the processes and steps for spatial planning, incl uding aquaculture zoning, site selection and area management. Part two of the publication includes six annexes that present key topics, including: (i) binding and non-legally binding international instruments, which set the context for sustainable national aquaculture; (ii) biosecurity zoning; (iii) aquaculture certification and zonal management; (iv) an overview of key tools and models that can be used to facilitate and inform the spatial planning process; (v) case studies from ten countries – Brazil, Chile, China, Indonesia, Mexico, Oman, the Philippines, Turkey, Uganda and the United Kingdom of Great Britain and Northern Ireland; and (vi) a workshop report. The country case studies illustrate key aspects of the implementation of spatial planning and management at the national level, but mostly within local contexts.

The agriculture sector employs nearly 66 percent of the workforce in the United Republic of Tanzania, thereby contributing to bringing the country closer to becoming a middle-income country. However, the sector, like all other sectors, is negatively impacted by the gender inequalities. To address the gender gaps in all sectors, including agriculture, the United Republic of Tanzania established the Ministry of Health, Community Development, Gender, Elderly and Children (MoHCDGEC) as the national institution to mainstream gender.

[Author] Activities under the project first started in Cabo Verde, Costa Rica, Côte d’Ivoire, Madagascar, Myanmar, Namibia, Oman, Philippines, Senegal and United Republic of Tanzania. This Research Topic focuses on bringing together perceptions and behaviour for sustainable coastal and island marine resource use systems. Management and governance of (large and small-scale) coastal marine resource use systems function in highly complex social and ecological environments, which are culturally embedded, economically interest-led and politically biased. Management processes therefore have to integrate multiple perspectives as well as perception-driven standpoints on the individual as well as the decision-makers’ levels. Consequently, the analysis of perceptions has developed not only as part of philosophy and psychology but also of environmental science, anthropology and human geography. It encompasses intuitions, values, attitudes, thoughts, mind-sets, place attachments and sense of place. All of these influence human behavior and action, and are collected or are available within the respective marine resource use system, which may support the livelihood of a large part of the local population. Management and governance are not only about mediating between resource use conflicts or establishing marine protected areas, they deal with people and their ideas and perceptions. Understanding the related decision-making processes on multiple scales and levels hence means much more than economically assessing the available marine resources or existing threats to the associated system. Over the past decade, there has been a growing inter- and transdisciplinary international community becoming interested in research which integrates perceptions of coastal and inland residents, local and regional stakeholder groups, as well as resource and environmental managers and decision-makers. By acknowledging the importance of the individual perspective and interest-led personal views, it became obvious how valuable and important these sources of information are for coastal research. An increase of research effort spent on the link between perceptions and behaviour in marine resource use systems is thus both timely and needed. By offering a diversity of inspiring and comprehensive contributions on the link between perceptions and behaviour, this Research Topic aspires to critically enlighten the discourse and applicability of such research for finding sustainable, locally identified, anchored and integrated marine resource use pathways.
