Book The Legal Foundations of Inequality

Download or read book The Legal Foundations of Inequality written by Roberto Gargarella and published by Cambridge University Press. This book was released on 2010-04-12 with total page 287 pages. Available in PDF, EPUB and Kindle. Book excerpt: The long revolutionary movements that gave birth to constitutional democracies in the Americas were founded on egalitarian constitutional ideals. They claimed that all men were created equal with similar capacities and also that the community should become self-governing. Following the first constitutional debates that took place in the region, these promising egalitarian claims, which gave legitimacy to the revolutions, soon fell out of favor. Advocates of a conservative order challenged both ideals and favored constitutions that established religion and created an exclusionary political structure. Liberals proposed constitutions that protected individual autonomy and rights but established severe restrictions on the principle of majority rule. Radicals favored an openly majoritarian constitutional organization that, according to many, directly threatened the protection of individual rights. This book examines the influence of these opposite views during the 'founding period' of constitutionalism in countries including the United States, Argentina, Colombia, Chile, Ecuador, Mexico, Peru, and Venezuela.

Book Legal Foundations of Education

Download or read book Legal Foundations of Education written by J.C. Blokhuis and published by Bloomsbury Publishing. This book was released on 2023-03-23 with total page 201 pages. Available in PDF, EPUB and Kindle. Book excerpt: In this volume, leading leading scholars and practitioners introduce law as foundational discipline in education. The legal foundations of education include the laws and policies through which particular states establish and maintain public school systems; require parents and guardians to enroll the children in their care in approved educational programs; mandate that particular subjects be taught in particular ways by persons with particular credentials; regulate teacher certification standards and teacher employment; and ensure school safety, effectiveness, and efficiency. Education law is a field of practice and scholarly inquiry within the legal foundations of education which is concerned primarily with the constitutional rights of students, teachers and other personnel in schools. About the Educational Foundations series: Education, as an academic field taught at universities around the world, emerged from a range of older foundational disciplines. The Educational Foundations series comprises six volumes, each covering one of the foundational disciplines of philosophy, history, sociology, policy studies, economics and law. This is the first reference work to provide an authoritative and up-to-date account of all six disciplines, showing how each field's ideas, methods, theories and approaches can contribute to research and practice in education today. The six volumes cover the same set of key topics within education, which also form the chapter titles: - Mapping the Field - Purposes of Education - Curriculum - Schools and Education Systems - Learning and Human Development - Teaching and Teacher Education - Assessment and Evaluation This structure allows readers to study the volumes in isolation, by discipline, or laterally, by topic, and facilitates a comparative, thematic reading of chapters across the volumes. Throughout the series, attention is paid to how the disciplines comprising the educational foundations speak to social justice concerns such as gender and racial equality.

The text includes approximately 400 examples and dozens of diagrams and tables that condense the law and clarify difficult concepts. This fourteenth edition has been substantially revised and restructured to take account of many important legislative reforms, case law developments, administrative changes and policy announcements. It is designed to be used in conjunction with the Core Tax Legislation and Study Guide 2022.

Book The Legal and Regulatory Environment of Business

Download or read book The Legal and Regulatory Environment of Business written by Robert Neil Corley and published by McGraw-Hill Companies. This book was released on 1996 with total page 776 pages. Available in PDF, EPUB and Kindle. Book excerpt: Upon its publication in 1963, Corley's Legal Environment of Business was the first and only business law textbook to emphasize public rather than private law, government regulation of business rather than contracts, and legal relationships rather than business transactions. A major innovation, it established a new course that the authors termed the legal environment of business. Over the years others have attempted to attain the success and stature of The Legal and Regulatory Environment of Business, but none has been able to match its timely, innovative coverage. Substantially updated, the 10th edition continues the text's reputation for ethics, authority and coverage of current areas of importance to business.

Book Theoretical Foundations of Law and Economics

Download or read book Theoretical Foundations of Law and Economics written by Mark D. White and published by Cambridge University Press. This book was released on 2011-08-18 with total page 0 pages. Available in PDF, EPUB and Kindle. Book excerpt: The economic approach to law, or "law and economics," is by far the most successful application of basic economic principles to another scholarly field, but most of the critical appraisal of the field has been scattered among law reviews and economics journals. Theoretical Foundations of Law and Economics is the first original, book-length examination of the methodology and philosophy of law and economics, featuring new essays written by leading legal scholars, philosophers, and economists. The contributors take issue with many of the key tenets of the economic approach to law, such as its assumption of rational behavior, its reliance on market analogies, and its adoption of efficiency as the primary goal of legal decision-making. They discuss the relevance of economics to the law in general, as well as to substantive areas of the law, such as contracts, torts, and crime.

It introduces the main approaches used by geotechnical and structural engineers, and the precautions required for planning, design and construction of foundation structures. The authors examine in depth the methods used for constructing shallow foundations, deep foundations, excavation and lateral support systems, slope stability analysis and construction, and ground monitoring for proper site management. Some new and innovative foundation construction methods are also introduced. It is illustrated with case studies of failures and defects from actual construction projects. Some advanced and modern theories are also covered in this book. This book is more targeted towards the understanding of the basic behavior and the actual construction of many geotechnical works, and this book is not dedicated to any design code or specification, though Euro codes and Hong Kong code are also used in this book for illustration. It is ideal for consulting geotechnical engineers, undergraduate and postgraduate students.
