Excavations have yielded, beside numerous literary compositions, a variety of documents concerning urban and temple administration as well as economic activities and property management of the priestly families. The book contains the publication of the legal and administrative documents from Old Babylonian Nippur kept in the Hilprecht Collection, Jena. The edition provides transliterations, translations, commentaries, hand copies, and photographs (on CD-ROM) of all texts. The indexes comprise personal names, toponyms, professions, deities, year-names, and a glossary. A separate chapter by Ursula Seidl discusses the iconography of seal impressions on the tablets. The legal documents are keystones of the family archives excavated by the Babylonian Expedition. The book also includes a discussion of the activities related in these archives and of the families who kept them. The administrative documents predominantly belong to a single archive and are characterized by an unusual dating system. The archive keeps track of sections of the management of the city and its temples.

Book excerpt: In Fragments and Assemblages, Arthur Bahr expands the ways in which we interpret medieval manuscripts, examining the formal characteristics of both physical manuscripts and literary works. Specifically, Bahr argues that manuscript compilations from fourteenth-century London reward interpretation as both assemblages and fragments: as meaningfully constructed objects whose forms and textual contents shed light on the city’s literary, social, and political cultures, but also as artifacts whose physical fragmentation invites forms of literary criticism that were unintended by their medieval makers. Such compilations are not simply repositories of data to be used for the reconstruction of the distant past; their physical forms reward literary and aesthetic analysis in their own right. The compilations analyzed reflect the full vibrancy of fourteenth-century London’s literary cultures: the multilingual codices of Edwardian civil servant Andrew Horn and Ricardian poet John Gower, the famous Auchinleck manuscript of texts in Middle English, and Chaucer’s Canterbury Tales. By reading these compilations as both formal shapes and historical occurrences, Bahr uncovers neglected literary histories specific to the time and place of their production. The book offers a less empiricist way of interpreting the relationship between textual and physical form that will be of interest to a wide range of literary critics and manuscript scholars.

Book excerpt: In recent years a series of scandals have challenged the traditional political reliance on public constitutional law and human rights as a safeguard of human well-being. Multinational corporations have violated human rights; private intermediaries in the internet have threatened freedom of opinion, and the global capital markets unleashed catastrophic risks. All of these phenomena call for a response from traditional constitutionalism. Yet it is outside the limits of the nation-state in transnational politics and outside institutionalized politics, in the 'private' sectors of global society that these constitutional problems arise. It is widely accepted that there is a crisis in traditional constitutionalism caused by transnationalization and privatization. How the crisis can be overcome is one of the major controversies of modern political and constitutional theory. This book sets out an answer to that problem. It argues that the obstinate state-and-politics-centricity of traditional constitutionalism needs to be counteracted by a sociological approach which, so far, has remained neglected in the constitutional debate. Constitutional sociology projects the questions of constitutionalism not only onto the relationship between public politics and law, but onto the whole society. It argues that constitutionalism has the potential to counteract the expansionist tendencies of social systems outside the state world, particularly of the globalized economy, science and technology, and the information media, when they endanger individual or institutional autonomy. The book identifies transnational regimes, particularly in the private area, as the new constitutional subjects in a global society, rivals to the order and power of nation states. It presents a model of transnational, societal constitutional fragments that could bring the values of constitutionalism to bear on these private networks, examining the potential horizontal application of human rights in the private sphere, and how such fragments could interact. An original and provocative contribution to the literature on modern constitutionalism, Constitutional Fragments is essential reading for all those engaged in transnational political theory.

Constitutional Ethos is a groundbreaking investigation into the fundamental principles of constitutional principle, meaning, and interpretation. It explores the core purposes of American representative democracy in light of historical sources, recent precedents, and contemporary debates. Alexander Tsesis argues that a central norm of U.S. law can be derived from the Declaration of Independence and Preamble. This book develops a theory of constitutional law structured on the public duty to protect individual rights for the general welfare. The maxim of constitutional governance synthesizes the protection of individual and public rights. The structure of government provides the mechanisms of those in a pluralistic state to set reasonable limitations for the betterment of society as a whole. Understanding the Constitution's special place in American legal culture is essential for resolving a host of contemporary issues; including, those involving marital, gender, and voting equalities. The state is a means of optimizing the well-being of individuals. Human productivity can best flourish in a society of equals, where talents can be brought to bear in the betterment of self and other members of the community. The Constitution does not create rights but protects those universal ideals of representative democracy first set out in the Declaration of Independence. It further grants authority to political institutions for the enforcement of policies and concrete laws for the betterment of society or some relevant segment of it. Many scholars with leanings in legal realism and process theory believe the authority of government is a social construct created by popular majorities; Tsesis convincingly demonstrates, to the contrary, that even those laws enacted by popular majorities are not authoritative unless they accord with a central maxim of constitutionalism, which is the protection of individual rights for the common good.

Book excerpt: This book presents a reassessment of the governmental systems of the Late Babylonian period—specifically those of the Neo-Babylonian and early Persian empires—and provides evidence demonstrating that these are among the first to have developed an early form of administrative law. The present study revolves around a particular expression that, in its most common form, reads ḫīṭu ša šarri išaddad and can be translated as “he will be guilty (of an offense) against the king.” The authors analyze ninety-six documents, thirty-two of which have not been previously published, discussing each text in detail, including the syntax of this clause and its legal consequences, which involve the delegation of responsibility in an administrative context. Placing these documents in their historical and institutional contexts, and drawing from the theories of Max Weber and S. N. Eisenstadt, the authors aim to show that the administrative bureaucracy underlying these documents was a more complex, systematized, and rational system than has previously been recognized. Accompanied by extensive indexes, as well as transcriptions and translations of each text analyzed here, this book breaks new ground in the study of ancient legal systems.
