Book excerpt: Though many of the legal issues that may be encountered using the design-build method of project delivery are the same or similar to legal issues encountered using other methods of project delivery, there are several issues unique to design-build which can significantly affect the success of the project and the parties involved in the design-build project. Differences in issues such as liability, insurance coverage, bonding, public procurement requirements and statutes, licensing, and changes in responsibilities and expectations of the contracting parties can lead to unexpected problems, conflict, and litigation. An owner or design-build entity that is not aware of or ignores these potential issues may encounter unanticipated problems. This report summarizes many of the key legal aspects unique to construction using the design-build method of project delivery. After explaining each of the potential issues, case law and rulings regarding these issues are cited, and suggestions for managing the issues (i.e., prevention or mitigation of problems) are offered. The report is directed to a general audience (i.e., owners, contractors and designers) and is not specific to any one of the typical parties involved in design-build.
