Available in PDF, EPUB and Kindle. Book excerpt: Excerpt from The Constitution, Its Origin, Function, and Authority: A Lecture Introductory to the Subject of Constitutional Law, Delivered Before the Law School of Harvard University I tell you what I think a Constitution is, and what is due from us to our Constitution, and what is due from our Constitution to us, before I can hope that you will think me less than extravagant, in what I have already said, and when I again declare that I regard this American invention, this Constitution, as the appointed means, by which the fabric of political society for man kind is, in coming ages, to gain new forms, new princi ples, new utility, and new life. What, then, is a Constitution? Simply, the law of the law of a nation. It is that supreme law, which the nation itself makes, as the condition and the lim itation of all the powers it will thereafter impart to its political servants. It is the guide which it gives to them all. It is the expression of the deliberate determination of the whole people, that the rights which it believes to lie at the foundation of all right, shall ever be preserved; that certain principles, which are to be as the life and essence of all law, shall ever be maintained; and it divides and defines, and yet connects by correlation, all the organic pow ers and functions of the State. And when the Con stitution is thus formed, it is thereafter the supreme law of every citizen of the State, be he high or low, be it his office to make, to execute, or to judge of law, or only to assist in laying these duties upon oth ers. To every man, and to every man alike, it is a supreme law. About the Publisher Forgotten Books publishes hundreds of thousands of rare and classic books. Book Constitutional Law

Download or read book Constitutional Law written by H. J. Fenton and published by Forgotten Books. This book was released on 2017-11-25 with total page 352 pages. Available in PDF, EPUB and Kindle. Book excerpt: Excerpt from Constitutional Law: An Introductory Treatise Designed for Use in the United States Naval Academy, and in Other Schools Where the Principles of the Constitution Are Studied Scope. - This book is introductory in scope. It is a study of the text of the Constitution and the principles of law per taining to it, designed mainly for those students who are just beginning their inquiry into the subject of law and gov ernment. By it it is hoped that the student may obtain such knowledge of the instrument of government under which this country has lived for more than a century as is almost requi site for a liberal education and for good citizenship; and that those who have the time and the inclination to pursue the subject further may be inspired to do so. Sources - Except perhaps in the use of cases and in certain minor details this book pretends to no originality. It is the business of the law writer, like the historian, to record rather than to make. It is partly from classroom notes, the product of ten years in the teacher's chair; partly from the writings of such excellent publicists as Story, Black, Cooley, mclain, Pomeroy, Wilson, Baldwin and Burgess; and partly from a wide reading among the cases decided by the Supreme Court that this book is compiled. Book excerpt: Excerpt from An Introduction to the Study of the Constitution: A Study Showing the Play of Physical and Social Factors in the Creation of Institutional Law In submitting the following work to the public a few words of explanation may not be out of place. It was written for the purpose of bringing before the student and reader of our American constitutional system a mass of information which at present lies scattered among the productions of many different writers, inquirers and thinkers. While it is not as serviceable a work to the active legal practitioner as so-called practical books may be, yet I believe it may lay claim to being of some use. Book excerpt: Excerpt from Lectures on Constitutional Law: For the Use of the Law Class at the University of Virginia Having presented to you, young gentlemen, in some former lectures, my views of the character and principles of the several forms of government, and particularly of the representative and confederate, we will now proceed to a more accurate examination of our own political system, which has been professedly constructed upon the combined principles of popular representation and an union of sovereign and independent states. I confidently believe that these enquiries will result in the conviction that whilst we have adopted a system without a prototype, we shall, nevertheless, find it eminently calculated to protect us from foreign aggression, and to secure the rights of life, liberty and property to every citizen of those free and happy republics. Before we proceed however with our task, it may not be improper to recall to your recollections certain points of our national history with which you are doubtless familiar, but which bear too materially upon our subject to be passed at least without a reference. The people of the United States, as you all are aware, are composed of the descendants of those subjects of the British crown, who, from various motives, left within the two last centuries their native isles and settled themselves upon this wild and desert continent. It is a principle of British law that if an uninhabited country is discovered and planted by British subjects. Download or read book An Introduction to the Constitutional Law of the United States written by John Norton Pomeroy and published by Forgotten Books. This book was released on 2017-09-16 with total page 614 pages. Available in PDF, EPUB and Kindle. Book excerpt: Excerpt from An Introduction to the Constitutional Law of the United States: Especially Designed for Students, General and Professional IN preparing the work of which the third edition is now offered to the public, the principal purpose of the author was to furnish for general readers, for colleges, law schools, and other higher seminaries, and for the legal profession, 'a book adapted to their present wants and based upon the principles of constitutional interpretation which have been settled by the civil war and by the political events that followed it. Although, as the name indicates, it is an Introduction and does not purport to be an absolutely exhaustive treatise, yet all the purely constitutional questions which have at any time been passed upon by the highest national tribunal, are discussed and the results thereof are stated. In respect to some of these topics, where there has been a conflict of opinion between the federal and the state courts, or where the relative powers of the national and state governments have been somewhat undefined and uncertain, the treatment has been designedly made more full and minute. Among the more important of these topics are the powers of taxing and of regulating commerce, the mil itary powers, the executive powers, the rights of citizenship, and state laws impairing the obligation of contracts. The work is thus intended for use as a text-book by the courts and the bar. About the Publisher Forgotten Books publishes hundreds of thousands of rare and classic books. It may perhaps be allowable to remind them that a book consisting of actually delivered lectures must, even though revised for publication, exhibit the characteristics inseparable from oral exposition, and that a treatise on the principles of the law of the constitution differs in its scope and purpose, as well from a constitutional history of England as from works like Bagehot's incomparable English Constitution, which analyse the practical working of our complicated system of modern Parliamentary government. If, however, I insist on the fact that my book has a special aim of its own, nothing is further from my intention than to u

Book excerpt: Excerpt from A Course of Lectures on the Constitutional Jurisprudence of the United States: Delivered Annually in Columbia College, New York IN submitting the following work to the public, there seems a necessity, as well as a propriety, in offering a preliminary explanation of its character and design; especially as he whose name it bears claims neither the merit of originality for his production, nor the title of author for himself. The present publication consists substantially of the Course of Lectures on the Consti tutional Jurisprudence of the United States, delivered annually to 'the Senior Class in Columbia College, while he had the honor of presiding in that venerable and noble institution. The outlines of those Lec tures were published some years ago, at the request of the american lyceum, an association consisting principally of persons engaged in the practical duties of mstruction, who conceived that the study of our na tional Constitution might be introduced wrth advents e into the general system of public education. That litt e treatise, accordingly, appeared in a form adapted to the views of those who had suggested its preparation; which were, fitness as a text-book for lecturers, a class book for academies and common schools, and a manual for popular use. Except, therefore, as to method and arrangement, as was observed in issuing it from the press, there could be little scope for originality in a. Book excerpt: Excerpt from Political and Constitutional Law of the United States of America The principles fundamental to political self-government, should doubtless be clearly understood by every vo'rnn or macros. For his status, in this country, is no less than that of one of a body of absolute sovereigns.l The three fundamentally different and mu tually opposing theories of our political system, - one or another of which every voter must necessarily sanction, and consequently, -one or another of which must furnish the key to every administra tion of government, state and federal, - are therefore severally and distinctly presented, so that every voter may judge for himself, as he ought to do, which of these theories should receive his assent and support. Attention is also directed to the different foundations of govern ment, to the rise and development of the system peculiar to Amer ica, to the sovereign legislation by the People themselves from the dawn of the Revolution to the xvth Amendment, and to the views and doctrines of the original framers of our Constitutions; ever so little reflection upon which will enable any voter to form his own independent opinion, regardless of partisan strifes, and to cast his vote with a clear understanding of what it involves. This book was released on 2015-09-27 with total page 662 pages. Available in PDF, EPUB and Kindle. Book excerpt: Excerpt from Principles of the Constitutional Law of the United States This volume is an abridgment of the author's larger treatise in two volumes, published in 1910 under the title The Constitutional Law of the United States. The aim has been to present the general principles of our constitutional jurisprudence in a form suitable for class-room use. In pursuance of this aim care has been taken to cite those cases which not only support the positions stated in the text but which Will best repay individual examination and study by the student. In particular the effort has been made to suggest, and in a measure to discuss, the unsettled questions of our Federal jurisprudence. The necessary limits of space have prevented in many instances an adequate presentation of the arguments supporting the doctrines stated, but, from a pedagogic point of view this may be a merit rather than a defect, for it will furnish opportunity for a presentation by the students of the court's reasoning as gained by a reading of the cases, and a criticism by the instructor of the reasoning as thus pre sented.
