Dès lors, lorsqu’il ne participe pas aux hostilités, il ne doit pas être pris pour cible dans les attaques, encore moins recruté par les belligérants. En tant que membre de la population civile, il bénéficie d’une protection générale contre les attaques et d’une protection spéciale essentiellement conçue en vue d’assurer ses besoins essentiels et le protéger contre les effets des hostilités. Nonobstant cette dernière mesure, il est souvent contraint de fuir en tant que réfugié ou déplacé à l’intérieur de son pays. En fait l’enfant peut se retrouver comme soldat au sein des forces et groupes armés. Pour cette raison la communauté internationale a réglementé son recrutement et sa participation aux hostilités. Ceux-ci commettent les pires atrocités de guerre. Face à cette situation, comment le droit international appréhende-t-il l’identité des enfants soldats ? s’agit-il de bourreaux et/ou de victimes ? Cette étude tente de démontrer que le corpus juridique élaboré par la communauté internationale protège efficacement l’enfant dans les conflits armés. Book excerpt: La protection des droits de l'enfant victime des conflits armés est une problématique récente et actuelle qui s'appuie sur l'évolution des droits de l'homme et sur la mutation de la nature des conflits. Elle pose la question de l'existence d'un cadre normatif international consistant, apte à assurer protection et assistance à l'enfant en proie à des hostilités. Sur ce point, il apparaît que le droit international prévoit un ensemble de mécanismes juridiques applicables à l'enfant, qu'il soit victime directe ou indirecte des conflits, ou qu'il participe directement aux hostilités. Aujourd'hui encore trop d'enfants meurent chaque jour à cause de conflits, de maladies, de Malnutrition beaucoup trop sont exploités et n'ont pas la possibilité de suivre des cours dans une école, voyant ainsi leur avenir leur échapper tous les jours un peu plus. Cependant, l'examen de ces instruments montre qu'ils se caractérisent souvent par la généralité de leurs dispositions qui ne sont pas toujours adaptées à la prise en compte de la spécificité de l'enfant. De plus, ils soulèvent parfois des questions d'applicabilité. Ainsi, si l'on ne peut pas leur nier toute effectivité, celle-ci reste, à bien des égards, partielle. L'adoption de mécanismes juridiques spécifiquement applicables à l'enfant, avait d'ailleurs pour objet de remédier à cette inadaptation et d'établir l'exhaustivité du cadre juridique. Ce respect les oblige à protéger les enfants afin de leur offrir la possibilité de bénéficier des programmes d'aide mis en place sur le terrain par de nombreuses organisations humanitaires clamant haut et fort que tout le monde doit agir, d'une manière ou d'une autre, pour permettre le développement d'actions de plus en plus variées et de plus en plus efficaces malgré les difficultés. La persistance des violations fait, cependant, prendre conscience des insuffisances normatives et impose une redéfinition de l'objectif de protection. Dans ce contexte, l'implication grandissante du Conseil de sécurité, mais aussi la criminalisation des violations commises lors des conflits armés, définissent une nouvelle approche de la responsabilité de la communauté internationale en la matière. Cette intervention a, en effet, permis de rappeler aux Etats leurs obligations et d'adopter des sanctions à l'encontre d'individus contrevenants. De même, les condamnations prononcées par la Cour pénale internationale et le Tribunal spécial pour la Sierra Léone pour crimes de guerre consistant au recrutement et à l'utilisation d'enfants soldats marquent la fin d'un déni de justice.

Book excerpt: Avec l'entrée en vigueur de la Convention des droits de l'enfant (CDE) en 1990, la communauté internationale a formellement matérialisé sa volonté de faire des droits de l'enfant, des droits à protéger en tout temps. La CDE vient compléter le dispositif juridique mis en place par le droit international humanitaire (DIH) pour protéger lesdits droits en période de conflit et inspirera la Charte africaine des droits et bien-être de l'enfant. Les Etats s'engagent ainsi à en faire une réalité, quelles que soient les circonstances. Mais l'engagement juridique est confronté aux conflits armés internes qui remettent en cause les droits fondamentaux clairement énoncés, notamment le droit à la santé et à l'éducation et qui favorisent la violation de ces droits. Dans ce mémoire, nous nous sommes interrogés sur les éventuelles causes qui peuvent expliquer que les engagements juridiques ne soient pas politiquement traduits en réalité concrète. Il s'agit de vérifier si le dispositif juridique de protection ne porte pas en lui-même les germes de cette violation. Une autre hypothèse serait que l'absence de reconnaissance formelle de la responsabilité des groupes armés non étatiques impliqués dans ces conflits, en ce qui concerne le respect des droits pourrait être un élément qui favorise les violations. Ainsi, dans la première partie, après avoir retracé l'évolution historique et juridique de la reconnaissance des droits de l'enfant, nous nous sommes inscrits dans le contexte du conflit en Côte d'Ivoire entre 2002 et 2011, pour montrer les impacts des conflits armés internes sur la jouissance des droits de l'enfant, notamment à la santé et à l'éducation. La deuxième partie nous permet de relever d'une part, les insuffisances du dispositif de protection, les lacunes relatives à la non prise en compte formelle des entités armées non étatiques, et de faire des réflexions en termes de perspectives pour une meilleure effectivité du respect des droits de l'enfant en période de conflit armé non international, d'autre part.

Book excerpt: International law has long differentiated between international and non-international armed conflicts, traditionally regulating the former far more comprehensively than the latter. This is particularly stark in the case of detention, where the law of non-international armed conflict contains no rules on who may be detained, what processes must be provided to review their detention, and when they must be released. Given that non-international armed conflicts are now the most common form of conflict, this is especially worrying, and the consequences of this have been seen in the detention practices of states such as the US and UK in Iraq and Afghanistan. This book provides a comprehensive examination of the procedural rules that apply to detention in non-international armed conflict, with the focus on preventive security detention, or 'internment'. All relevant areas of international law, most notably international humanitarian law and international human rights law, are analysed in detail and the interaction between them explored. The book gives an original account of the relationship between the relevant rules of IHL and IHRL, which is firmly grounded in general international law scholarship, treating the issue as a matter of treaty interpretation. With that in mind, and with reference to State practice in specific non-international armed conflicts - including those in Sri Lanka, Colombia, Nepal, Afghanistan, and Iraq - it is demonstrated that the customary and treaty obligations of States under human rights law continue, absent derogation, to apply to detention in non-international armed conflicts. The practical operation of those rules is then explored in detail. The volume ends with a set of concrete proposals for developing the law in this area, in a manner that builds upon, rather than replaces, the existing obligations of States and non-State armed groups.
