Si ces critères tirés de l'environnement analogique peuvent s'adapter dans l'environnement numérique « hors ligne », leur recours dans l'environnement ouvert des réseaux numériques est plus délicat. Dans l'environnement « en ligne », la transmission numérique des oeuvres peut donner lieu à d'innombrables reproductions provisoires. Ne durant parfois qu'un temps de raison, il est possible de douter d'une application stricte du droit de reproduction. En créant une exception de reproduction technique provisoire, le législateur fait échapper ces actes de reproduction au droit exclusif. Si la notion de reproduction s'adapte finalement à l'environnement numérique, qu'il soit fermé ou ouvert, il reste à déterminer si le droit de reproduction a toujours une place primordiale au sein du droit d'auteur. Sa pertinence s'explique car les mesures techniques de protection vont permettre d'améliorer son efficacité; mais il faut se méfier de la neutralité de la technique, qui peut conduire à des risques d'arbitraire ou à une violation du droit au respect de la vie privée. C'est pourquoi, le droit de reproduction, au travers d'une application raisonnée de l'exception de copie privée, peut être considéré comme un droit à rémunération venant compenser les pertes financières subies par les auteurs et les titulaires de droits.

Cet ouvrage répond également, au souci d'établir une politique d'intégration de l'enseignement technique du droit d'auteur dans le cursus scientifique dans les établissements supérieurs et universitaires de la République Démocratique du Congo, en particulier, et de l'Afrique en général. Il conviendra, à ce sujet, d'approfondir les questions de techniques du droit d'auteur, en complément des questions juridiques, lorsqu'il s'agira des grandes écoles de formation artistique et des sciences sociales et de communication ainsi que des facultés de droit.
