Book Balancing Copyright A Survey of National Approaches

Download or read book Balancing Copyright A Survey of National Approaches written by Reto Hilty and published by Springer Science & Business Media. This book was released on 2012-06-15 with total page 1083 pages. Available in PDF, EPUB and Kindle. Book excerpt: How does copyright law take into account the interests of third parties, especially the general public’s interest in the greatest possible dissemination of knowledge and culture? Twelve basic questions give copyright law experts from more than forty countries the opportunity to provide answers related to their national law on the following matters: categories of works and subject matter, eligibility conditions, duration, “users’ rights,” the three-step test, misuse, differentiations between categories of right holders, TPM, and relations of copyright law to other legal areas such as fundamental rights, competition law, consumer protection law, media law etc. The standardized form of the reports makes it easy to see the impacts of copyright law in the industrialized countries as well as in emerging economies; in common-law and civil-law approaches; in countries of the Andean Community and of the European Union, as well as in countries that are not party to the WIPO Treaties. A detailed preliminary chapter provides an approachable overview of issues and results. This chapter also discusses the voice of academia, represented by the European Copyright Code of the “Wittem Group.”

Book Intellectual Property Law in France

Download or read book Intellectual Property Law in France written by Nicolas Bouche and published by Kluwer Law International B.V.. This book was released on 2020-01-14 with total page 490 pages. Available in PDF, EPUB and Kindle. Book excerpt: Derived from the renowned multi-volume International Encyclopaedia of Laws, this monograph provides a survey and analysis of the rules concerning intellectual property rights in France. It covers every type of intellectual property right in depth – copyright and neighbouring rights, patents, utility models, trademarks, trade names, industrial designs, plant variety protection, chip protection, trade secrets, and confidential information. Particular attention is paid throughout to recent developments and trends. The analysis approaches each right in terms of its sources in law and in legislation, and proceeds to such legal issues as subject matter of protection, conditions of protection, ownership, transfer of rights, licences, scope of exclusive rights, limitations, exemptions, duration of protection, infringement, available remedies, and overlapping with other intellectual property rights. The book provides a clear overview of intellectual property legislation and policy, and at the same time offers practical guidance on which sound preliminary decisions may be based. Lawyers representing parties with interests in France will welcome this very useful guide, and academics and researchers will appreciate its value in the study of comparative intellectual property law.

Book Ownership of Rights in Audiovisual Productions

Download or read book Ownership of Rights in Audiovisual Productions written by Salokannel and published by Martinus Nijhoff Publishers. This book was released on 2023-09-14 with total page 399 pages. Available in PDF, EPUB and Kindle. Book excerpt: In a single generation audiovisual production technology has made two enormous leaps: interactivity and digital exploitation. Any law that deals with satellite transmission must take into account the ownership rights in audiovisual productions, and maintain a clear perspective on how existing laws in the field have been adapted - and will continue to be adapted - to protect authors. Who owns the digital exploitation rights in the audiovisual work? Who is entitled to collect remunerations collected from private copying? How do moral rights affect the licensing of rights in audiovisual works? These are some of the most contentious questions dealt with in this book. The book provides a comprehensive comparative framework for analysis of the regulation of ownership of rights in audiovisual productions in Europe. It is the first presentation that examines these issues in the light of revised Nordic copyright laws and the respective national regulations of Germany, France, Belgium, the United Kingdom and the United States. In addition, the book explains in detail how international and European Community regulations affect rights owners in audiovisual productions. The audiovisual sector is also an area where the differences between the civil law systems of author's rights and common law based copyright systems are particularly pronounced. This book clarifies some of the common misunderstandings encountered in this respect.

Book Intellectual Property Overlaps

Download or read book Intellectual Property Overlaps written by Estelle Derclaye and published by Bloomsbury Publishing. This book was released on 2011-05-11 with total page 406 pages. Available in PDF, EPUB and Kindle. Book excerpt: Intellectual property rights, conventionally seen as quite distinct, are increasingly overlapping with one another. There are several reasons for this: the expansion of IPRs beyond their traditional borders, the creation of new IPRs especially at EU level, the exploitation of gaps in the law by shrewd lawyers, and the use of unfair competition as an alternative when IPRs are either not available at all or expired. The convergence of several IPRs on the same subject-matter poses problems. As they are normally envisaged as water-tight categories, there are very few rules which cater for the sort of regime clash that any overlap of IPRs necessarily entails. This book's aim is to find appropriate rules to regulate overlaps and thereby avoid regime conflicts and undue unstructured expansion of IPRs. The book studies the practical consequences of each overlap at the international, European and national levels (where the laws of France, the UK and Germany are reviewed). It then analyses the reasons for the prohibition or authorisation of overlaps. This analysis enables the determination of criteria and principles that can be used to (re)map the overlaps to achieve appropriateness and legitimacy.

Book The Parody Exception in Copyright Law

Download or read book The Parody Exception in Copyright Law written by Sabine Jacques and published by Oxford University Press. This book was released on 2019-03-07 with total page 305 pages. Available in PDF, EPUB and Kindle. Book excerpt: Parodies have been created throughout times and cultures. A glimpse at the general judicial latitude generally afforded to parodies, satires, caricatures, and pastiches demonstrates the social and cultural value of this particular form of artistic expression. With the advent of technologies and the evolution of copyright legislation, creative endeavours in the form of parody gathered a new youth but became unlawful. While copyright law grants exclusive rights to right-holders, this right is not absolute. Legislation includes specific exceptions, which preclude right-holders from exercising their prerogatives in particular cases which foster creativity and cultural diversity within that society. The parody exception pertains to this ultimate objective by permitting users to reproduce copyright-protected materials for the purpose of parody. To understand the meaning and scope of the parody exception, this book examines and compares five jurisdictions which differ in their protection of parodies: France, Australia, Canada, the US and the United Kingdom. This book is concerned with finding an appropriate balance between the protection awarded to right-holders and the public interest. This is achieved by analysing the parody exception to the economic rights of right-holders, the preservation of moral rights and the interaction of the parody exception with contract law. As parodies constitute an artistic expression protected under the right to freedom of expression, this book also considers the influence of freedom of expression on the interpretation of this specific copyright exception. Furthermore, this book aims at providing guidance on how to resolve conflicts where fundamental rights are in conflict. This is the first book in English to offer an in-depth investigation into the parody exception in copyright law, and comments on industry practices linked to this form of creative endeavours.

Book Multimedia Research and Documentation of Oral Genres in Africa

Download or read book Multimedia Research and Documentation of Oral Genres in Africa written by Daniela Merolla and published by LIT Verlag Münster. This book was released on 2012 with total page 156 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book approaches a central concern of oral literature studies worldwide, with a special focus on Africa: how to deal with oral genres in a world where new technologies have become available to more and more people? As the book asserts, what is new is that the spotlight is directed towards (old and new) "interlocutors" who cooperate in the making of technologized oral genres in an increasingly technologized world. Their interactions affect the performance, as well as research - their roles and positions raise methodological and ethical questions particularly when local/national identities and commercial interests are at stake. Download or read book Copyright Law is Obsolete written by Anna Mancini and published by BUENOS BOOKS AMERICA LLC. This book was released on 2006 with total page 126 pages. Available in PDF, EPUB and Kindle. Book excerpt: Copyright laws worldwide were created for a publishing world where books were tangible, printed in a limited number and sold within territory based markets. Technological changes are giving place to a new book market where books are intangible, exist in unlimited number of copies and travel worldwide in an increasingly global market. In this emerging global book market made possible by the conjunction of the Internet, e-book technologies, DRM and print on demand devices, the three important legal concepts traditionally used in copyright laws have become obsolete: territory, property and the Aristotelian idea of justice. These three concepts were well suited to the tangible book market but are no longer for the virtual book market where persons matter more than objects. This book invites the reader to explore the specific functioning of the virtual economy. It proposes guidelines to modernize copyright law so that it can foster an adequate use of new communication technologies. For the first time in History, the humankind has acquired a technology that allows to create a world of information affluence and freedom of speech or its opposite. This book explains why the option for abundance and freedom must prevail, how the law can support this movement and what would be, to the contrary, the disastrous consequences of the other option. This book goes beyond a simple reflection on the book market and considers the choice of society, even of civilization implied by the use, right or wrong, of the new communication technologies.
