Cette dualité en fait un "laboratoire" particulièrement intéressant qui permet d'aborder deux points principaux. On peut tout d'abord s'interroger sur la possibilité de concilier la conception traditionnellement humaniste du droit d'auteur français avec les enjeux économiques attachés au développement de l'industrie des "contenus". Mais on doit aussi envisager les rapports entre le droit de la propriété littéraire et artistique et le droit de la communication, qui a notamment pour vocation de protéger la création nationale. Dans cette perspective, l'étude de la propriété littéraire et artistique appliquée à l'audiovisuel conduit à mener une double démonstration. Tout d'abord, il apparaît que le régime juridique de l'objet audiovisuel, loin de révéler une spécificité de ce type de création qui imposerait de distinguer un droit de la propriété littéraire et artistique "classique" d'un droit de la propriété littéraire et artistique "économique", illustre au contraire la souplesse de la conception française du droit d'auteur, capable, en tenant compte de la nature de la création audiovisuelle, de concilier humanisme et pragmatisme. Ensuite, l'influence du droit de la communication sur le droit d'auteur et les droits voisins révèle les fondements profondément différents de ces deux droits, qui, s'ils voient leurs domaines d'application se croiser, n'en poursuivent pas moins des objectifs différents. S'il importe donc de prendre conscience des répercussions, réelles, du droit de la communication sur la situation des auteurs et auxiliaires de la création, on ne peut pas pour autant en déduire l'existence d'un droit de l'audiovisuel réunissant les dispositions du droit public et du droit privé applicables à l'audiovisuel, l'incohérence de ce droit étant trop importante pour qu'il puisse prétendre à l'autonomie.
