Book excerpt: Longtemps ignorée des enjeux de la construction européenne, la politique d'asile et de protection des réfugiés constitue depuis quelques années une question majeure de l'agenda politique de l'Union européenne. Entre " crise de l'asile " et " risque migratoire ", la protection des réfugiés a été l'objet d'un amalgame sécuritaire dans une Europe repliée sur le mythe de " l'immigration zéro ". Le présent ouvrage se propose de mettre en lumière les effets de la construction communautaire, et plus particulièrement l'émergence d'un espace sans frontières, sur le développement d'une politique d'asile européenne. A travers une analyse critique des évolutions institutionnelles amorcées depuis l'Acte unique européen, l'auteur s'interroge sur la maturité politique de l'Europe et sur la viabilité du modèle d'intégration communautaire dans une Europe élargie. Sur le plan conceptuel, une analyse critique de l'acquis communautaire démontre que l'européanisation de la politique d'asile a été jusqu'à présent fortement inspirée des pratiques restrictives des pays membres. Si le traité d'Amsterdam, entré en vigueur le 1er mai 1999, ouvre des perspectives nouvelles en procédant à la " communautarisation " de la politique d'asile, des interrogations demeurent sur la teneur des règles communautaires et sur l'émancipation des règles européennes par rapport aux principes de droit international. Enfin, cet ouvrage explore également les difficultés suscitées par le processus d'élargissement de l'Union européenne aux pays d'Europe centrale et orientale, et plus particulièrement à la Pologne, la Hongrie, la République tchèque et la Slovénie. Alors que les Etats membres ont développé des pratiques unilatérales de renvois des demandeurs d'asile et des migrants vers les " pays tiers sûrs ", les perspectives d'adhésion à l'Union européenne ont considérablement modifié les données du problème puisque les pays candidats sont à présent dans l'obligation d'harmoniser leurs dispositions nationales avec les règles de l'acquis communautaire. Constituant les futures frontières orientales de l'Union européenne, les pays d'Europe centrale forment de ce fait un véritable " cordon sécuritaire " séparant l'Union européenne des pays générateurs de flux de réfugiés et de migrants. A travers l'étude des sources du droit d'asile, de l'émergence d'une politique européenne en matière d'asile et de ses conséquences sur les pays d'Europe centrale, le lecteur pourra acquérir une vision globale des défis posés par la mise en place d'un " espace de liberté, de sécurité et de justice " dans un continent en pleine mutation.

The fact that WEP workers are denied the legal status of employees and make far less money and enjoy fewer rights than do city workers has sparked fierce opposition. For antipoverty activists, legal advocates, unions, and other critics of the program this double standard begs a troubling question: are workfare participants workers or welfare recipients?
