Parce que la recherche de l'intérêt général imprègne l'ensemble du droit pharmaceutique sans excclure pour autant la satisfaction des intérêts particuliers des industries de la pharmacie, l'écriture du droit pharmaceutique européen poursuit un double objectif. Un objectif public d'une part : la protection de la santé publique. Un objectif privé d'autre part : le maintien de la compétitivité des laboratoires européens au travers de la protection de l'innovation pharmaceutique. Parce que la conceptualisation de la santé et l'affirmation contemporaine du droit à la santé conduisent à envisager le médicament comme objet d'ordre public, le droit pharmaceutique, qui est l'une des composantes du droit de la santé, se doit d'encadrer strictement la mise à disposition des médicaments. La réalisation de cet objectif implique notamment une définition extensive du médicament, la création de procédures communautaires d'autorisation de mise sur le marché, la surveillance de la publicité des médicaments, l'imputabilité aux laboratoires de la responsabilité du fait des produits défectueux et le contrôle des conditions de mise en oeuvre de l'exception de santé publique. Parce qu'il demeur soumis aux principes communautaires fondamentaux, le droit pharmaceutique se doit d'assurer le respect des droits de propriétés industrielle dont disposent les laboratoires tout en veillant à ce que la libre circulation des marchandises et la libre concurrence ne soient pas compromises par un exercice abusif de ces droits. La réalisation de cet objectif passe notamment par la prise en compte de la spécificité de l'innovation pharmaceutique, la lutte contre la contrefaçon de médicaments, l'ajustement du droit de la concurrence et des droits de propriété industrielle, ainsi que par l'application communautaire de la théorie de l'épuisement de ces droits.
