Cette étude se propose d'analyser, au moyen de la méthode de la « dialectique ouverte », la portée de ce concept dans l'ordre juridique international. Il s'agit, en particulier, d'identifier ses effets normatifs et de préciser la manière dont il s'articule aux autres concepts (« souveraineté » notamment). L'idée qui est défendue ici est que l'humanité complexifie l'ordre juridique international, mais ne le bouleverse pas radicalement. En effet, si l'humanité est un principe fondamental du droit international public, elle n'est pas une personne juridique du droit international public. Au titre de principe fondamental, l'humanité travaille en profondeur les droits de l'homme, le droit humanitaire, le droit de la bioéthique, le droit pénal international, le droit de l'environnement, le droit des espaces et bouscule le droit des traités et de la responsabilité internationale. Mais l'humanité reste un sujet passif du droit international public : titulaire de droits, elle est dépourvue d'une représentation qui lui permettrait de les exercer. Il n'est ni possible, ni souhaitable de mettre sur pied une institution centralisée qui incarnerait l'humanité. Aujourd'hui ce sont les Etats qui, à titre principal, sont garants des droits de l'humanité. Cette solution, cependant, n'est pas satisfaisante : la gestion de ces droits doit être le fait d'une pluralité de mandataires, ce qui implique l'existence d'une véritable communauté humaine.
